{"id":13286,"date":"2017-05-17T16:31:00","date_gmt":"2017-05-17T20:31:00","guid":{"rendered":"http:\/\/www.publicknowledge.org\/uncategorized\/small-but-powerful-despite-objections-small-isps-need-net-neutrality-too\/"},"modified":"2017-05-17T16:31:00","modified_gmt":"2017-05-17T20:31:00","slug":"small-but-powerful-despite-objections-small-isps-need-net-neutrality-too","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/small-but-powerful-despite-objections-small-isps-need-net-neutrality-too\/","title":{"rendered":"Small but Powerful: Despite Objections, Small ISPs Need Net Neutrality Too"},"content":{"rendered":"<p dir=\"ltr\"><em>Update: Since the publication of this blog post, dozens of small ISPs came out in support of the current net neutrality rules in a <a href=\"\/wp-content\/uploads\/2019\/10\/Small_ISP_Letter_to_FCC.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">letter<\/a> addressed to Chairman Pai.<\/em><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-2b14e42a-1744-7547-217a-caff9c4a1d6d\">As we gear up to <\/span><a href=\"https:\/\/petitions.signforgood.com\/ProtectNetNeutrality\/?code=PK\" target=\"_blank\" rel=\"noopener noreferrer\">defend and protect the net neutrality rules<\/a>, parties on both sides are speaking up. One particular group, small Internet Service Providers, claim that the Federal Communication Commission\u2019s <a href=\"{page_3399}\" target=\"_blank\" rel=\"noopener noreferrer\">2015 Open Internet Order<\/a> has been a death sentence for them, hindering their ability to invest and compete in the market. These small ISPs have taken to advocating against net neutrality rules but there is something missing from their claims: substance.<\/p>\n<p><span id=\"docs-internal-guid-2b14e42a-1744-7547-217a-caff9c4a1d6d\" style=\"font-size: 1.6rem;\">Usually represented by trade groups like the Competitive Carriers Association, US Telecom Association, and the American Cable Association, to name a few, <\/span><a style=\"font-size: 1.6rem;\" href=\"https:\/\/ecfsapi.fcc.gov\/file\/60001025667.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">small ISPs generally serve<\/a><span style=\"font-size: 1.6rem;\"> a customer base in the hundreds or thousands. Compare that to the likes of Comcast, Verizon, Charter, and AT&amp;T, which <\/span><a style=\"font-size: 1.6rem;\" href=\"http:\/\/www.newsweek.com\/telecom-companies-overcharge-customers-532484\" target=\"_blank\" rel=\"noopener noreferrer\">control 70 percent of the market<\/a><span style=\"font-size: 1.6rem;\">, with consumer counts in the millions.<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-2b14e42a-1744-7547-217a-caff9c4a1d6d\">Given their comparatively small size, these small ISPs don\u2019t believe the net neutrality rules should apply to them. <\/span><a href=\"http:\/\/www.wispa.org\/Portals\/37\/Docs\/Press%20Releases\/70_WISPS_Letter.pdf?ver=2017-05-09-125315-817\" target=\"_blank\" rel=\"noopener noreferrer\">Citing<\/a> regulatory burdens of complying with the Open Internet Order and the uncertainty of the newly minted rules, they believe the rules put them in a high cost\/low benefit situation because they don\u2019t have the same market power or <a href=\"https:\/\/ecfsapi.fcc.gov\/file\/60001031556.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">incentive<\/a> to make deals with edge providers. But these claims are hollow.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-2b14e42a-1744-7547-217a-caff9c4a1d6d\">First, the idea that these companies don&#8217;t have &#8220;market power&#8221; is wrong. <\/span><a href=\"https:\/\/arstechnica.com\/information-technology\/2017\/05\/title-ii-hasnt-hurt-network-investment-according-to-the-isps-themselves\/\" target=\"_blank\" rel=\"noopener noreferrer\">Many of them are monopolies in the areas they serve.<\/a> It&#8217;s true that most smaller ISPs don&#8217;t have the same upstream clout to block or degrade online services in exchange for toll payments as larger ISPs. They can block the services and make the demands, but the payments are less likely to be forthcoming, since they don&#8217;t control access to millions of customers. But the Open Internet rules are not designed just to address the kinds of economic extortion that are the specialty of the largest ISPs. They also exist <a href=\"http:\/\/whatisnetneutrality.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">to ensure that customers can access the internet content and services of their choice<\/a>. It&#8217;s easy to see a small ISP cutting a deal with, for example, DirecTV, to bundle its satellite or online services with their internet service, and throttling the bandwidth available to competing video services. You don&#8217;t need to have the scale of Comcast to enter into these kinds of deals, and the Open Internet rules should protect the users of small ISPs as well as large ones.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-2b14e42a-1744-7547-217a-caff9c4a1d6d\">Additionally, none of the small ISPs or trade associations that represent them actually point to or identify the particular regulations that are oh-so-burdensome to their businesses. In the last fight for net neutrality, their biggest concern was the <\/span><a href=\"https:\/\/apps.fcc.gov\/edocs_public\/attachmatch\/DOC-332260A1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">enhanced transparency requirements<\/a>, which require ISPs to disclose promotional rates, fees, surcharges, and data caps, as well as information regarding network management practices. After much debate, the FCC <a href=\"https:\/\/arstechnica.com\/information-technology\/2017\/01\/fcc-exempts-small-isps-from-broadband-truth-in-billing-rules\/\" target=\"_blank\" rel=\"noopener noreferrer\">extended<\/a> an exemption to these rules to any ISP with fewer than 250,000 subscribers (originally capped at 100,000 subscribers) for an additional five years. Despite this fact, these groups are still crying wolf.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-2b14e42a-1744-7547-217a-caff9c4a1d6d\">It is also worth noting that many of these small ISPs are not paragons of free enterprise, but get <\/span><a href=\"https:\/\/www.fcc.gov\/general\/universal-service-high-cost-areas-connect-america-fund\" target=\"_blank\" rel=\"noopener noreferrer\">government subsidies<\/a> in exchange for providing internet service to rural areas that are often harder to serve. Generally speaking, companies that receive public benefits are expected to serve the public. Unfortunately, several ISPs have abused this program &#8211; taking the government funds but <a href=\"https:\/\/apps.fcc.gov\/edocs_public\/attachmatch\/DOC-328183A1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">failing to provide service<\/a>. Last year, the FCC imposed <a href=\"https:\/\/apps.fcc.gov\/edocs_public\/attachmatch\/DOC-342429A1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">millions of dollars in fines<\/a> against small ISPs and has <a href=\"http:\/\/www.telecompetitor.com\/fcc-seeks-more-than-76-million-from-two-carriers-for-alleged-universal-service-violations\/\" target=\"_blank\" rel=\"noopener noreferrer\">continued to investigate<\/a> fraud and abuse of the Universal Service Fund. Yet here they stand, claiming not to have the power to do harm and wanting fewer regulations.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-2b14e42a-1744-7547-217a-caff9c4a1d6d\">While small ISPs would like to have you believing that they are under attack due to the net neutrality rules, it\u2019s simply not true. In fact, they haven\u2019t been able to point out particularly \u201cburdensome regulations\u201d that are causing their distress. Instead, they are making empty claims and in some instances, already displaying the power they do in fact have to abuse the system.
