{"id":14905,"date":"2005-10-14T21:55:49","date_gmt":"2005-10-15T01:55:49","guid":{"rendered":"http:\/\/www.publicknowledge.org\/uncategorized\/the-new-ipod-and-consumer-expectations\/"},"modified":"2005-10-14T21:55:49","modified_gmt":"2005-10-15T01:55:49","slug":"the-new-ipod-and-consumer-expectations","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/the-new-ipod-and-consumer-expectations\/","title":{"rendered":"The New iPod and Consumer Expectations"},"content":{"rendered":"<p>What a cool <a href=\"http:\/\/www.apple.com\/ipod\/ipod.html\">new device Apple<\/a> has made us all lust over!  <strong>Again!<\/strong>  Not only is it thinner than the previous generation of iPods, it sports a wider color screen capable of playing back video.  And you can download select TV shows from the <a href=\"http:\/\/www.apple.com\/itunes\/overview\/\">iTunes Music Store<\/a>.    Now on the way to work, I can watch <a href=\"http:\/\/www.oceanicflight815.com\/\">Lost<\/a> and find all the clues that I&#8217;ve missed the night before.<\/p>\n<p>Of course, the video playback is not limited to the TV shows, there are pleanty of <a href=\"http:\/\/phobos.apple.com\/WebObjects\/MZStore.woa\/wa\/viewPlayListsPage?fcId=73331673&amp;pageType=playlists&amp;id=33\">video podcasts<\/a> (FYI: that&#8217;s an iTunes link) for you to select from&#8212;I usually watch <a href=\"http:\/\/www.rocketboom.com\">Rocketboom<\/a> while eating lunch at my desk.  And then there&#8217;s all the videos I already own.<\/p>\n<p>I have a few movies on VHS that I could do a an &#8220;A-to-D&#8221; conversion on&#8212;digitally record to my computer using an <a href=\"http:\/\/elgato.com\/\">EyeTV<\/a> or just my regular firewire camcorder as a pass-thru.  It&#8217;d take some time, but it could be done.<\/p>\n<p>And of course, my DVD collection.  Since those are just discs with digital video files on them.  It should be easy enough to down-convert them on my computer to the proper resolution for the iPod.  <a href=\"http:\/\/www.engadget.com\/entry\/1234000027063418\/\">And it is pretty easy<\/a>.  Sheesh, it only took two days for a tutorial to be put on a very popular blog.<\/p>\n<p>But, unlike all the video content (both analog and digital) listed before, it&#8217;s <strong>illegal to digitally copy this DVD video content to your new iPod<\/strong>.  <a href=\"http:\/\/www.publicknowledge.org\/issues\/dmca\">We all know why<\/a>.  Sure, you could copy the video from the analog out, then copy it back digitally, then down-rez it.  A &#8220;D-to-A-to-D&#8221; conversion, if you will.<\/p>\n<p>Does anyone else think this is absurd?  You own the content.  You own the device.  And you&#8217;re not doing anything illegal with the content under traditional copyright law.<\/p>\n<p>Thankfully, some <a href=\"http:\/\/www.personaltech.org\/\">other folks do to<\/a>.  One in particular is <a href=\"http:\/\/www.house.gov\/boucher\/\">U.S. Representative Rick Boucher<\/a>, of Virginia.  This is not hot news, but he&#8217;s got <a href=\"http:\/\/www.publicknowledge.org\/issues\/hr1201\">a bill<\/a> in Congress that essentially says if you&#8217;re not doing it for otherwise infringing purposes, it&#8217;s not illegal to conduct fair use.<\/p>\n<p>If it were to pass, you wouldn&#8217;t be breaking the law while watching your DVDs on your iPod, on the way to work.
