{"id":15083,"date":"2017-05-08T20:29:00","date_gmt":"2017-05-09T00:29:00","guid":{"rendered":"http:\/\/www.publicknowledge.org\/uncategorized\/the-truth-about-net-neutrality-and-infrastructure-investment\/"},"modified":"2017-05-08T20:29:00","modified_gmt":"2017-05-09T00:29:00","slug":"the-truth-about-net-neutrality-and-infrastructure-investment","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/the-truth-about-net-neutrality-and-infrastructure-investment\/","title":{"rendered":"The Truth About Net Neutrality and Infrastructure Investment"},"content":{"rendered":"<p dir=\"ltr\"><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\">The Federal Communications Commission\u2019s <\/span><a href=\"{page_4003}\" target=\"_blank\" rel=\"noopener noreferrer\">Open Internet Order of 2015<\/a> finally put net neutrality rules on a firm legal basis, protecting consumers from the anti-competitive, anti-consumer schemes that monopolistic Internet Service Providers would otherwise subject them to.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\"><a href=\"{page_3981}\" target=\"_blank\" rel=\"noopener noreferrer\">Consumers made it clear<\/a><\/span> in 2015 that they supported the Open Internet Order\u2019s successful adoption of net neutrality principles that prevents ISPs from blocking websites, throttling speeds, and engaging in paid prioritization of content. With the Order in place, ISPs could no longer engage in these practices, but they weren\u2019t done trying. They <a href=\"\/wp-content\/uploads\/2019\/10\/170425_Letter_from_22_Small_ISPs.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">claim<\/a> that they need to be released from the rules because more rules mean ISPs were disincentivized from upgrading and expanding their networks. But these investment <a href=\"http:\/\/www.chamberlitigation.com\/sites\/default\/files\/cases\/files\/2015\/Motion%20for%20Stay%20or%20Expedition%20with%20Attachments%20and%20Exhibits%20--%20U.S.%20Telecom%20Assn.%20v.%20FCC%20%28CADC%29.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">arguments<\/a> simply don\u2019t hold up.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\">Unfortunately, the new FCC Chairman, Ajit Pai, is buying these arguments. At a recent event, Chairman Pai <\/span><a href=\"{page_4873}\" target=\"_blank\" rel=\"noopener noreferrer\">announced his plan<\/a> to undo the 2015 Open Internet Order and remove all the consumer protections that are currently the law of the land. While opponents point to company <a href=\"https:\/\/consumerist.com\/2016\/02\/09\/did-net-neutrality-kill-broadband-investment-like-comcast-att-verizon-said-it-would\/\" target=\"_blank\" rel=\"noopener noreferrer\">financial statements<\/a> for their proof, Chairman Pai and his \u201ceconomists\u201d continue to use <a href=\"http:\/\/transition.fcc.gov\/Daily_Releases\/Daily_Business\/2017\/db0426\/DOC-344590A1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">abstract hypotheticals<\/a>. It\u2019s essential to the future of net neutrality that we shed some light (and truth) on the baseless arguments being made.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\">Fact: ISPs have no plans to decrease investment in their infrastructure.<\/span> ISPs have been reporting to investors that investment is up, up, up! <a href=\"http:\/\/seekingalpha.com\/article\/2743375-verizon-communications-vz-presents-at-ubs-42nd-annualglobal-media-and-communications-conference-transcript?all=true&amp;find=John%2BHodulik\" target=\"_blank\" rel=\"noopener noreferrer\">Verizon\u2019s<\/a> CFO, Fancis Shammo, told investors that reclassification to Title II \u201cdoes not influence the way we invest.\u201d Similarly, <a href=\"https:\/\/ecfsapi.fcc.gov\/file\/60001013965.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Sprint<\/a> stated that it would \u201ccontinue to invest in data networks regardless of whether they are regulated by Title II, Section 706, or some other light touch regulatory regime.\u201d Just last year, <a href=\"https:\/\/www.att.com\/Investor\/ATT_Annual\/2016\/downloads\/att_ar2016_letter_to_shareholders.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">AT&amp;T<\/a> reassured their investors that they would \u201cremain one of the largest investors in the United States.\u201d As technologies change and reliance on the internet only continues to strengthen, ISPs know the value in continued investment.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\">Fact: Investment has actually increased since the adoption of the Open Internet Order. <\/span>In the last two years, the largest ISPs have continued to grow and invest in the infrastructure needed to ensure continued dominance in the marketplace. <a href=\"https:\/\/www.freepress.net\/sites\/default\/files\/resources\/free_press_broadband_market_one_year_later.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Capital expenditures<\/a> (money that a company invests to acquire or maintain things like buildings and equipment) have steadily increased since the adoption of the rules &#8211; they have increased <a href=\"https:\/\/mobile.nytimes.com\/2017\/04\/29\/opinion\/sunday\/fcc-invokes-internet-freedom-while-trying-to-kill-it.html\" target=\"_blank\" rel=\"noopener noreferrer\">by more than 5 percent<\/a> for ISPs since the rules have been put in place. In fact, investment is on the rise for Comcast, AT&amp;T, CenturyLink, and Verizon, and there is nothing in their financial statements that indicates a slowdown. Additionally, <a href=\"https:\/\/consumerist.com\/2017\/02\/28\/fcc-chair-claims-broadband-investment-at-historic-low-level-because-of-net-neutrality-thats-not-what-the-numbers-say\/\" target=\"_blank\" rel=\"noopener noreferrer\">stock prices<\/a> are up for AT&amp;T, Comcast, and Charter, while Verizon\u2019s stock prices have remained at a similar level.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\">Fact: Investment, by nature, does not necessarily continuously increase. <\/span>A trend of increased investment in infrastructure is often followed by a decrease. <a href=\"https:\/\/www.freepress.net\/sites\/default\/files\/resources\/free_press_broadband_market_one_year_later.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">For example<\/a>, AT&amp;T experienced a decline in wireline capital expenditures in 2015 logically following the completion of its 4G LTE upgrade, which had increased its investment in infrastructure. As existing technologies are updated and new technologies emerge, investment in such technologies will continue to fuel the industry, but investment will ebb and flow with such developments.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\">Fact: Investment does not rise or fall purely because of regulatory changes. <\/span>Investment decisions are influenced by a long list of factors, not just one in isolation. This <a href=\"https:\/\/www.freepress.net\/sites\/default\/files\/resources\/free_press_broadband_market_one_year_later.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">includes<\/a> things like the level of market competition, the success of prior investment deployments, tax incentives and interest rates, the company\u2019s existing financial position, and the general health of the economy. Pinning a change in investment on any one regulatory decision is not in step with the reality of the way business decisions are made.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\">Fact: Investment decisions are made far in advance.<\/span> Before a company invests millions or even billions of dollars and countless hours of labor, they plan. ISPs <a href=\"{page_1843}\" target=\"_blank\" rel=\"noopener noreferrer\">plan their investment projects<\/a> years in advance, after considering all the variables at play and taking the time to fully weigh their options.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\">Fact: ISPs are not investing for consumers, they\u2019re investing for profits. <\/span>Commissioner Pai claims that an override of net neutrality protections would lead to increased profits for ISPs, which leads to increased infrastructure investments, which in turn leads to an increase in American jobs and broadband access for all. But in the past, increased profits have not meant increased investment for ISPs. Instead, ISPs have shown that they are <a href=\"{page_1846}\" target=\"_blank\" rel=\"noopener noreferrer\">taking their profits<\/a> and using them to <a href=\"{page_1846}\" target=\"_blank\" rel=\"noopener noreferrer\">buy up other companies<\/a> &#8211; which further <a href=\"https:\/\/www.freepress.net\/ownership\/chart\" target=\"_blank\" rel=\"noopener noreferrer\">consolidates the market<\/a> and <a href=\"{page_4731}\" target=\"_blank\" rel=\"noopener noreferrer\">eliminates consumer choice<\/a> &#8211; instead of deploying new networks.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\">Fact: There has been an increase in investment in the internet as a whole.<\/span> ISPs focus on the investments that they make in <a href=\"https:\/\/en.wikipedia.org\/wiki\/Last_mile\" target=\"_blank\" rel=\"noopener noreferrer\">\u201clast mile\u201d access<\/a>. But this ignores a much bigger picture that also includes <a href=\"https:\/\/en.wikipedia.org\/wiki\/Internet_backbone#Tier_1_providers\" target=\"_blank\" rel=\"noopener noreferrer\">backbone providers<\/a>, middle mile providers, <a href=\"http:\/\/www.seattletimes.com\/business\/technology\/amazon-microsoft-invest-billions-as-computing-shifts-to-cloud\/\" target=\"_blank\" rel=\"noopener noreferrer\">cloud service providers<\/a> like IBM, Microsoft<a href=\"http:\/\/www.seattletimes.com\/business\/technology\/amazon-microsoft-invest-billions-as-computing-shifts-to-cloud\/\">, <\/a>and Amazon, internet companies like Snapchat and Twitter, and the independent online creators that run their own websites or take advantage of existing distribution platforms. But for net neutrality and an open internet, we wouldn\u2019t have <a href=\"{page_4269}\" target=\"_blank\" rel=\"noopener noreferrer\">innovative new services<\/a> online.<\/p>\n<p><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\" style=\"font-size: 1.6rem;\">When a new player wants to enter the marketplace, it already faces a laundry list of challenges when up <\/span><a style=\"font-size: 1.6rem;\" href=\"https:\/\/www.theverge.com\/2017\/2\/3\/14495750\/snapchat-ipo-net-neutrality-cost-fcc-hurt-business\" target=\"_blank\" rel=\"noopener noreferrer\">against a field of incumbents<\/a><span style=\"font-size: 1.6rem;\">. It\u2019s because of a truly open internet that new entrants at least have an opportunity and a fighting chance at getting their voices out to consumers. Without protections, newcomers to the market would be discouraged from the get-go, knowing that their content might only be accessible at a slower rate than its incumbent competitors. This is the <\/span><a style=\"font-size: 1.6rem;\" href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/09-17-14LivierTestimony.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">same plight<\/a><span style=\"font-size: 1.6rem;\"> that minority communities face in getting their content to consumers, and it is the same open internet that gives them the opportunity to connect with others.<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-96198075-e9c1-0a52-3286-2e3eaacba147\">The FCC\u2019s adoption of the Open Internet Order took strides to protect consumers and remind ISPs that the internet should stay just that, open. A claim of decreased investment in infrastructure is simply unfounded and incorrect.
