{"id":18577,"date":"2019-12-10T10:41:47","date_gmt":"2019-12-10T15:41:47","guid":{"rendered":"https:\/\/www.publicknowledge.org\/?p=18577"},"modified":"2021-12-03T19:59:11","modified_gmt":"2021-12-03T19:59:11","slug":"two-years-later-broadband-providers-are-still-taking-advantage-of-an-internet-without-net-neutrality-protections","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/two-years-later-broadband-providers-are-still-taking-advantage-of-an-internet-without-net-neutrality-protections\/","title":{"rendered":"Two Years Later, Broadband Providers Are Still Taking Advantage of An Internet Without Net Neutrality Protections"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">This December marks the two-year anniversary of the <\/span><a href=\"https:\/\/www.publicknowledge.org\/press-release\/fcc-abandons-consumer-protection-responsibility-with-net-neutrality-repeal\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Federal Communications Commission\u2019s vote<\/span><\/a><span style=\"font-weight: 400;\"> to repeal the <\/span><a href=\"https:\/\/www.fcc.gov\/document\/fcc-releases-open-internet-order\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">2015 Open Internet Order<\/span><\/a><span style=\"font-weight: 400;\"> and the agency\u2019s <\/span><a href=\"https:\/\/www.publicknowledge.org\/issues\/net-neutrality\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">net neutrality consumer protections<\/span><\/a><span style=\"font-weight: 400;\">. Even though <\/span><a href=\"https:\/\/www.publicconsultation.org\/united-states\/overwhelming-bipartisan-public-opposition-to-repealing-net-neutrality-persists\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">86 percent of Americans support net neutrality<\/span><\/a><span style=\"font-weight: 400;\"> and opposed the reversal, two years ago the FCC chose to side with the major broadband providers over consumers regarding who controls access to internet content, and consumers are experiencing the grave effects of that choice.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Earlier this year Public Knowledge detailed some of the ways <\/span><a href=\"https:\/\/www.publicknowledge.org\/blog\/broadband-providers-are-quietly-taking-advantage-of-an-internet-without-net-neutrality-protections\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">broadband providers have been quietly taking advantage of an internet without net neutrality protections<\/span><\/a><span style=\"font-weight: 400;\"> and where the FCC has no legal authority to police harmful conduct by broadband providers.<\/span><span style=\"font-weight: 400;\"> These examples included <\/span><a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2018-11-08\/sprint-is-throttling-microsoft-s-skype-service-study-finds\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Sprint throttling internet traffic to Microsoft\u2019s Skype<\/span><\/a><span style=\"font-weight: 400;\">, a service that competes with Sprint\u2019s calling service; Verizon\u2019s throttling of services that affected the <\/span><a href=\"https:\/\/arstechnica.com\/tech-policy\/2018\/08\/verizon-throttled-fire-departments-unlimited-data-during-calif-wildfire\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Santa Clara County Fire Department\u2019s<\/span><\/a><span style=\"font-weight: 400;\"> ability to provide emergency services during the California wildfires; and <\/span><a href=\"https:\/\/boingboing.net\/2018\/09\/17\/gougin-in-the-rain.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">other examples<\/span><\/a><span style=\"font-weight: 400;\"> that show how <\/span><span style=\"font-weight: 400;\">broadband providers have used the lack of net neutrality rules to their advantage to profit from slowing down certain types of internet traffic and favoring certain types of content. Some supporters of the repeal justify the FCC\u2019s action by claiming that the internet did not slow to a crawl or cease to exist, hence net neutrality protections and FCC oversight of broadband providers is unnecessary. The truth is, without net neutrality protections, the internet is slowly changing to favor the decisions of major broadband providers over consumers, and broadband providers continue to take advantage:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Consumers\u2019 real-time location data originating from cell phone providers, including T-Mobile, AT&amp;T, and Sprint, is being <\/span><a href=\"https:\/\/www.vice.com\/en_us\/article\/nepxbz\/i-gave-a-bounty-hunter-300-dollars-located-phone-microbilt-zumigo-tmobile\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">sold to bounty hunters<\/span><\/a><span style=\"font-weight: 400;\"> and others. Domestic abusers have used the easy availability of this geolocation data to stalk current and former partners. This data is also being resold on the black market. According to these wireless companies, this use of data goes against the company\u2019s policies, but when net neutrality rules were repealed, so too was the FCC\u2019s authority to regulate broadband privacy.<\/span><\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/news.northeastern.edu\/2019\/08\/27\/northeastern-university-researcher-finds-that-wireless-networks-are-throttling-video-streaming-24-7\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Researchers from Northeastern University and University of Massachusetts Amherst<\/span><\/a><span style=\"font-weight: 400;\"> found that almost all <\/span><a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2019-08-19\/wireless-carrier-throttling-of-online-video-is-pervasive-study\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">wireless carriers pervasively slow down internet speed<\/span><\/a><span style=\"font-weight: 400;\"> for selected video streaming services. From early 2018 to early 2019, AT&amp;T throttled Netflix 70% of the time as well as YouTube 74% of the time, but not Amazon Prime Video. T-Mobile throttled Amazon Prime Video in about 51% of the tests, but did not throttle Skype or Vimeo. While U.S. wireless carriers have long said they may slow video traffic on their networks to avoid congestion, one of the study\u2019s authors, David Choffnes, explained that these carriers are throttling content \u201call the time, 24\/7, and it\u2019s not based on networks being overloaded.\u201d No throttling internet traffic is a core net neutrality principle.&nbsp;&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Broadband provider Cox Communications is <\/span><a href=\"https:\/\/www.vice.com\/en_us\/article\/neabyw\/this-isp-is-offering-a-fast-lane-for-gamersfor-dollar15-more-per-month\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">offering a \u201cfast lane\u201d for gamers<\/span><\/a><span style=\"font-weight: 400;\"> who pay $15 more per month.\u201d If net neutrality protections existed, broadband providers cannot set up \u201cfast lanes\u201d\u2014also known as \u201cpaid prioritization\u201d\u2014to force users to pay more for prioritized access to the internet.&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Frontier <\/span><span style=\"font-weight: 400;\">Communications is <\/span><a href=\"https:\/\/onezero.medium.com\/killing-net-neutrality-was-even-worse-than-you-think-132a21aab55a\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">charging its customers<\/span><\/a><span style=\"font-weight: 400;\"> a $10 monthly modem rental fee even if they already own their modems. If users buy their own modem to avoid such fees, the ISP will still charge them as if they are renting one. The FCC used to have broadband oversight authority to address this problematic behavior, but without such authority, the FCC has told Congress that this is now the FTC\u2019s problem to deal with.&nbsp;<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The purpose of having FCC oversight of broadband providers and net neutrality rules is to have an expert agency investigate these issues when they arise to ensure the internet remains open to everyone and that broadband providers do not abuse their consumers or take advantage of their power to determine what type of internet content gets seen. <\/span><a href=\"https:\/\/whatisnetneutrality.tumblr.com\/timeline\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Net neutrality rules were created<\/span><\/a><span style=\"font-weight: 400;\"> in order to protect the consumer\u2019s ability to access all internet content equally rather than internet service providers deciding which websites to block, throttle, or prioritize and which to allow unfettered access. When implementing net neutrality rules, the Commission understood that internet providers (e.g. Comcast, Verizon) have profit motives and that large content providers (e.g. Netflix, Amazon Prime) can afford to pay for prioritization. As the cop on the beat, the FCC had the authority to step in if necessary to protect consumers. After the current FCC\u2019s 2017 repeal of net neutrality and the agency\u2019s oversight authority over broadband, consumers no longer have net neutrality protections or a federal agency ready to address harmful conduct by broadband providers, leading to the aforementioned examples of companies taking advantage of consumers, their wallets, and their data.&nbsp;&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Two years ago, upon repealing the net neutrality rules, FCC Chairman Ajit Pai <\/span><a href=\"https:\/\/www.theverge.com\/2017\/12\/14\/16777626\/ajit-pai-net-neutrality-speech\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">gave a speech<\/span><\/a><span style=\"font-weight: 400;\"> about all the wonderful things killing net neutrality would do. None of them have come true. For example, Chairman Pai said:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201c<\/span><i><span style=\"font-weight: 400;\">[The repeal<\/span><\/i><i><span style=\"font-weight: 400;\">] is not going to stifle free expression online<\/span><\/i><span style=\"font-weight: 400;\">.\u201d But this is simply not true. As wireless carriers throttle certain content providers and not others, consumers are witnessing internet service providers stifle the free expression of certain content. The internet is a place where everyone can have a voice regardless of how much money they make, yet this premise is being threatened without net neutrality protections.For example, while some consumers and businesses can pay for internet \u201cfast lanes,\u201d those that cannot afford to will have their voices silenced.&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201c<\/span><i><span style=\"font-weight: 400;\">We are helping consumers and promoting competition. Broadband providers will have stronger incentives to build networks, especially in unserved areas<\/span><\/i><span style=\"font-weight: 400;\">.\u201d This also has proven to be false. Rather than promoting competition, broadband providers now have carte blanche to prioritize their own content and throttle competing services. The repeal particularly harms small businesses who will not be able to pay for prioritization, and will likely be the targets of content throttling. <\/span><span style=\"font-weight: 400;\">Moreover, the promise of more network investment has not occurred (<\/span><a href=\"https:\/\/www.vice.com\/en_us\/article\/kz4g9x\/study-proves-the-fccs-core-justification-for-killing-net-neutrality-was-false\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">nor did net neutrality consumer protections lead to any decline in network investment<\/span><\/a><span style=\"font-weight: 400;\">). To the contrary, <\/span><a href=\"https:\/\/www.techdirt.com\/articles\/20191030\/14275843294\/shocker-isps-cut-back-2020-investment-despite-tax-breaks-death-net-neutrality.shtml\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">despite billions in tax breaks and a constant stream of deregulation from the FCC, broadband investment has not ticked up<\/span><\/a><span style=\"font-weight: 400;\">. AT&amp;T announced it will <\/span><a href=\"https:\/\/arstechnica.com\/information-technology\/2019\/10\/att-is-cutting-capital-investment-from-23-billion-to-20-billion\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">cut its capital investment by $3 billion<\/span><\/a><span style=\"font-weight: 400;\"> in 2020 and it has mostly stopped its fiber-to-the-home broadband construction. Verizon\u2019s 2019 spending has been flat, and Comcast and Charter have not invested as much as previously estimated.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201c<\/span><i><span style=\"font-weight: 400;\">We also promote much more robust transparency among ISPs than existed three years ago.<\/span><\/i><span style=\"font-weight: 400;\">\u201d This sentiment cannot be true in a world where a bounty hunter can pay for someone\u2019s real-time geolocation data without the ISPs even knowing about it. Members of Congress and members of the FCC have been unable to get any update from the Chairman\u2019s office on the investigation regarding the sale of location data.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">From the start, transparency and increased investment as justifications for killing FCC authority and repealing net neutrality were nothing but a red herring. <\/span><a href=\"https:\/\/www.techdirt.com\/articles\/20161214\/06063436271\/comcast-admits-net-neutrality-rules-had-no-real-impact-company.shtml\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Cable and telco executives have long told Wall Street that net neutrality rules do not affect investment decisions<\/span><\/a><span style=\"font-weight: 400;\">. And remember, earlier this year <\/span><a href=\"https:\/\/www.buzzfeednews.com\/article\/jsvine\/net-neutrality-fcc-fake-comments-impersonation?bftwnews&amp;utm_term=4ldqpgc#4ldqpgc\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">BuzzFeed discovered<\/span><\/a><span style=\"font-weight: 400;\"> that millions of fake net neutrality comments were submitted by groups working for broadband companies.<\/span><span style=\"font-weight: 400;\">&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The FCC\u2019s repeal of net neutrality and abdication of oversight authority have been incredibly harmful to consumers. <\/span><a href=\"https:\/\/www.publicknowledge.org\/act-now\/tell-congress-to-save-net-neutrality\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">It is time for Congress to act<\/span><\/a><span style=\"font-weight: 400;\"> and codify the net neutrality rules that were enacted in 2015. Earlier this year, the House <\/span><a href=\"https:\/\/www.publicknowledge.org\/press-release\/public-knowledge-applauds-house-for-passing-save-the-internet-act-to-restore-net-neutrality\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">passed<\/span><\/a><span style=\"font-weight: 400;\"> Congressman Mike Doyle\u2019s (D-PA) Save the Internet Act. Senator Markey (D-MA) introduced the companion bill <\/span><a href=\"https:\/\/www.publicknowledge.org\/press-release\/public-knowledge-urges-senate-to-pass-save-the-internet-act-to-restore-net-neutrality\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">in the Senate<\/span><\/a><span style=\"font-weight: 400;\">, and it has 45 cosponsors. However, it has been sitting idly in the Senate for months.
