Circuit\u2019s Remand Fails to Promote the Public Interest"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Today, Federal Communications Commission Chairman Pai <\/span><a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/DOC-367357A1.pdf\"><span style=\"font-weight: 400;\">published a draft Order<\/span><\/a><span style=\"font-weight: 400;\"> that would reaffirm the agency\u2019s <\/span><a href=\"https:\/\/www.publicknowledge.org\/press-release\/fcc-abandons-consumer-protection-responsibility-with-net-neutrality-repeal\"><span style=\"font-weight: 400;\">2017 net neutrality repeal<\/span><\/a><span style=\"font-weight: 400;\">. The vote is a response to a 2019 remand by the D.C. Circuit Court of Appeals in <\/span><a href=\"https:\/\/www.publicknowledge.org\/press-release\/public-knowledge-applauds-d-c-circuit-court-ruling-preventing-fcc-from-blocking-state-net-neutrality-laws\/\"><i><span style=\"font-weight: 400;\">Mozilla v. FCC<\/span><\/i><\/a><span style=\"font-weight: 400;\"> ordering the agency to address how its net neutrality repeal could harm public safety, pole attachments, and even the Lifeline program.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The net neutrality rules created by the FCC\u2019s 2015 Open Internet Order prevented broadband providers from blocking websites, throttling web traffic, or creating \u201cfast lanes\u201d only for those able to pay for prioritization. Millions of Americans <\/span><a href=\"https:\/\/www.theverge.com\/2014\/9\/16\/6257887\/fcc-net-neutrality-3-7-million-comments-made\"><span style=\"font-weight: 400;\">expressed support for these rules<\/span><\/a><span style=\"font-weight: 400;\"> by <\/span><a href=\"https:\/\/www.fcc.gov\/ecfs\/search\/filings?proceedings_name=17-108&amp;sort=date_disseminated,DESC\"><span style=\"font-weight: 400;\">submitting comments<\/span><\/a><span style=\"font-weight: 400;\"> with the FCC, and <\/span><a href=\"http:\/\/www.publicconsultation.org\/united-states\/overwhelming-bipartisan-public-opposition-to-repealing-net-neutrality-persists\/\"><span style=\"font-weight: 400;\">more than 80 percent of Americans<\/span><\/a><span style=\"font-weight: 400;\"> consistently say they support restoring the protections the FCC adopted in the 2015 Open Internet Order. Chairman Pai\u2019s FCC <\/span><a href=\"https:\/\/www.publicknowledge.org\/press-release\/fcc-abandons-consumer-protection-responsibility-with-net-neutrality-repeal\"><span style=\"font-weight: 400;\">repealed these rules<\/span><\/a><span style=\"font-weight: 400;\"> in 2017, effectively stripping Americans of these consumer protections that are so fundamental in an increasingly online world.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Public Knowledge, a litigant in <\/span><i><span style=\"font-weight: 400;\">Mozilla v. FCC<\/span><\/i><span style=\"font-weight: 400;\">, has <\/span><a href=\"https:\/\/whatisnetneutrality.tumblr.com\/timeline#_=_\"><span style=\"font-weight: 400;\">consistently fought for strong net neutrality rules<\/span><\/a><span style=\"font-weight: 400;\"> and will continue <\/span><a href=\"https:\/\/www.publicknowledge.org\/act-now\/tell-congress-to-save-net-neutrality\/\"><span style=\"font-weight: 400;\">urging the public to speak out<\/span><\/a><span style=\"font-weight: 400;\"> about the importance of a free and open internet.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The following can be attributed to John Bergmayer, Legal Director at Public Knowledge:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe Commission&#8217;s draft does not show how its reckless move to abandon oversight of broadband can adequately promote public safety, universal service, and access to infrastructure by broadband providers (pole attachments). Rather, it has concluded that deregulation is more important than achieving those goals. This is consistent with the practice of the Commission under Chairman Pai, which continues to ignore the growing harms of failing to exert its authority over broadband, despite the <\/span><a href=\"http:\/\/www.publicconsultation.org\/united-states\/overwhelming-bipartisan-public-opposition-to-repealing-net-neutrality-persists\/\"><span style=\"font-weight: 400;\">chorus of Americans<\/span><\/a><span style=\"font-weight: 400;\"> demanding affordable, equitable access to broadband that is reliable, secure and open.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe draft order dismisses real public safety harms as irrelevant, and genuine fears as \u2018speculative,\u2019 as though its own predictions of how public safety would be affected by the Commission&#8217;s abandonment, for the first time, of oversight of broadband providers was anything but that. It concedes that broadband-only internet service providers will lose access to pole attachment rights but simply doesn&#8217;t care \u2014 failing to foresee the obvious future where most ISPs are broadband-only. Its approach to universal service similarly depends on ISPs perpetually offering regulated services as a means of qualifying for support.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe Commission&#8217;s answers to the questions that the D.C. Circuit remanded to it are inadequate, and represent an abandonment of its statutory goals. These are fatal flaws for the Pai FCC&#8217;s radical and untested deregulatory agenda. It is increasingly clear that oversight of broadband to ensure public safety, universal service, and an open internet should be a top priority for Congress.
