{"id":22214,"date":"2021-02-08T13:13:52","date_gmt":"2021-02-08T13:13:52","guid":{"rendered":"https:\/\/www.publicknowledge.org\/?post_type=press_release&#038;p=22214"},"modified":"2024-12-12T22:18:49","modified_gmt":"2024-12-12T22:18:49","slug":"public-knowledge-petitions-fcc-to-begin-reconsidering-trump-era-broadband-deregulation","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/public-knowledge-petitions-fcc-to-begin-reconsidering-trump-era-broadband-deregulation\/","title":{"rendered":"Public Knowledge Petitions FCC to Begin Reconsidering Trump-Era Broadband Deregulation"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Today, Public Knowledge filed a <\/span><a href=\"https:\/\/www.publicknowledge.org\/documents\/public-knowledge-net-neutrality-petition-for-reconsideration\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">petition<\/span><\/a><span style=\"font-weight: 400;\"> asking the Federal Communications Commission to reconsider the <\/span><a href=\"https:\/\/www.publicknowledge.org\/press-release\/fcc-abandons-consumer-protection-responsibility-with-net-neutrality-repeal\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">agency\u2019s determination under Chairman Pai<\/span><\/a><span style=\"font-weight: 400;\"> that its deregulatory agenda was more important than public safety, the infrastructure access necessary for broadband competition, or universal service. The <\/span><a href=\"https:\/\/www.publicknowledge.org\/press-release\/public-knowledge-applauds-d-c-circuit-court-ruling-preventing-fcc-from-blocking-state-net-neutrality-laws\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">D.C. Circuit Court of Appeals<\/span><\/a><span style=\"font-weight: 400;\">, while upholding much of the Pai FCC\u2019s order, reversed the agency\u2019s attempt to preempt state regulation of broadband and ordered the FCC to reconsider its approach to several important policy issues. Public Knowledge\u2019s petition focuses on procedural and legal defects in how the FCC considered these issues.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The net neutrality rules created by the FCC\u2019s 2015 Open Internet Order prevented broadband providers from blocking websites, throttling web traffic, or creating \u201cfast lanes\u201d only for those able to pay for prioritization. Millions of Americans <\/span><a href=\"https:\/\/www.theverge.com\/2014\/9\/16\/6257887\/fcc-net-neutrality-3-7-million-comments-made\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">expressed support for these rules<\/span><\/a><span style=\"font-weight: 400;\"> by <\/span><a href=\"https:\/\/www.fcc.gov\/ecfs\/search\/filings?proceedings_name=17-108&amp;sort=date_disseminated,DESC\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">submitting comments<\/span><\/a><span style=\"font-weight: 400;\"> with the FCC, and <\/span><a href=\"http:\/\/www.publicconsultation.org\/united-states\/overwhelming-bipartisan-public-opposition-to-repealing-net-neutrality-persists\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">more than 80 percent of Americans<\/span><\/a><span style=\"font-weight: 400;\"> consistently say they support restoring the protections the FCC adopted in the 2015 Open Internet Order. Chairman Pai\u2019s FCC <\/span><a href=\"https:\/\/www.publicknowledge.org\/press-release\/fcc-abandons-consumer-protection-responsibility-with-net-neutrality-repeal\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">repealed these rules<\/span><\/a><span style=\"font-weight: 400;\"> in 2017, effectively stripping Americans of these consumer protections that are so fundamental in an increasingly online world.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Public Knowledge, a litigant in <\/span><i><span style=\"font-weight: 400;\">Mozilla v. FCC<\/span><\/i><span style=\"font-weight: 400;\">, has <\/span><a href=\"https:\/\/publicknowledge.org\/net-neutrality-timeline\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">consistently fought for strong net neutrality rules<\/span><\/a><span style=\"font-weight: 400;\"> and will continue <\/span><a href=\"https:\/\/www.publicknowledge.org\/act-now\/tell-congress-to-save-net-neutrality\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">urging the public to speak out<\/span><\/a><span style=\"font-weight: 400;\"> about the importance of a free and open internet.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The following can be attributed to Kathleen Burke, Policy Counsel at Public Knowledge:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cOur petition asks the FCC to reconsider the previous FCC\u2019s approach to the D.C. Circuit\u2019s <\/span><a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/DOC-367357A1.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Remand Order<\/span><\/a><span style=\"font-weight: 400;\">. In its rush to get its deregulatory orders out the door, the Commission cut many procedural corners. This alone provides grounds for the FCC to reopen and reverse its previous determinations.
