Download <a href=\"https:\/\/publicknowledge.org\/wp-content\/uploads\/2022\/04\/Movin-On-Up-A-LIttle-Higher-Blog-Charts-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">detailed charts<\/a> of both legislative proposals to follow along with our analysis.<\/em><\/strong><\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.youtube.com\/watch?v=RBVVztMA4CQ\" target=\"_blank\" rel=\"noreferrer noopener\">Black-empowerment<\/a> <a href=\"https:\/\/www.youtube.com\/watch?v=WP1zKat-x4s\" target=\"_blank\" rel=\"noreferrer noopener\">hit-maker<\/a> James Brown mostly sang about movement \u2013 <a href=\"https:\/\/www.youtube.com\/watch?v=BCCkb6k_aow\" target=\"_blank\" rel=\"noreferrer noopener\">physical<\/a>, <a href=\"https:\/\/www.youtube.com\/watch?v=yeTP6qsu0Bo\" target=\"_blank\" rel=\"noreferrer noopener\">mental<\/a>, <a href=\"https:\/\/www.youtube.com\/watch?v=wnUM34orQ0M\" target=\"_blank\" rel=\"noreferrer noopener\">emotional<\/a>, <a href=\"https:\/\/www.youtube.com\/watch?v=xbq0OuJtErs\" target=\"_blank\" rel=\"noreferrer noopener\">spiritual<\/a>, <a href=\"https:\/\/www.youtube.com\/watch?v=GaB9F3R9cIY\" target=\"_blank\" rel=\"noreferrer noopener\">social<\/a>, <a href=\"https:\/\/www.youtube.com\/watch?v=SmrZRcfYWvA\" target=\"_blank\" rel=\"noreferrer noopener\">political<\/a>, and even <a href=\"https:\/\/www.youtube.com\/watch?v=ncvBBjb3iU4\" target=\"_blank\" rel=\"noreferrer noopener\">economic<\/a>. <a href=\"https:\/\/www.goodreads.com\/en\/book\/show\/79034.The_Godfather_of_Soul\" target=\"_blank\" rel=\"noreferrer noopener\"><em>The Godfather of Soul<\/em><\/a> recalls being dehydrated and fatigued on tour, but he jolted back to life when he saw the audience in a Fort Lauderdale club reflecting his exhaustion. He yelled \u201c<a href=\"https:\/\/www.youtube.com\/watch?v=CNlrIHWLAFA\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Get Up Offa That Thang<\/em><\/a><em>, and dance \u2018til you feel better\u2026 SING!<\/em>&#8221; And that was the birth of his 1974 smash-hit. <strong>The cure for collective exhaustion was <em>movement<\/em>.<\/strong> As consumers, we are exhausted with the harms of some of the largest digital platforms. We all want the choice to start moving. But, <a href=\"https:\/\/www.theatlantic.com\/technology\/archive\/2019\/05\/in-person-protests-stronger-online-activism-a-walking-life\/578905\/\" target=\"_blank\" rel=\"noreferrer noopener\">movement away from the largest digital platforms<\/a> isn\u2019t easy. Nevertheless, we must push ourselves and our communities to \u201cGet Up Offa Them Thangs\u201d with interoperability.<\/p>\n\n\n\n<p><strong>A growing class of Afro-descendant tech entrepreneurs have heard and experienced the downsides of the largest digital platforms and have decided to create their own platforms. <\/strong>The <a href=\"https:\/\/www.ebony.com\/life\/how-big-tech-wins-on-the-backs-of-black-people\/\" target=\"_blank\" rel=\"noreferrer noopener\">pre-Facebook social media<\/a> network <a href=\"https:\/\/blackplanet.com\" target=\"_blank\" rel=\"noreferrer noopener\">Black Planet<\/a>, as well as <a href=\"https:\/\/twitter.com\/thecookoutapp_\" target=\"_blank\" rel=\"noreferrer noopener\">The Cookout<\/a>, <a href=\"https:\/\/www.iambean.us\" target=\"_blank\" rel=\"noreferrer noopener\">Bean<\/a>, <a href=\"https:\/\/ramse.tech\" target=\"_blank\" rel=\"noreferrer noopener\">RAM\u015aE<\/a>, and <a href=\"https:\/\/news.virginia.edu\/content\/black-twitter-101-what-it-where-did-it-originate-where-it-headed\" target=\"_blank\" rel=\"noreferrer noopener\">Black Twitter<\/a>, all want to compete with Facebook to create <a href=\"https:\/\/www.pewresearch.org\/internet\/2021\/01\/13\/the-state-of-online-harassment\/\" target=\"_blank\" rel=\"noreferrer noopener\">safer<\/a> and <a href=\"https:\/\/www.washingtonpost.com\/technology\/2021\/11\/21\/facebook-algorithm-biased-race\/\" target=\"_blank\" rel=\"noreferrer noopener\">more inclusive<\/a> spaces for Black communities. <a href=\"https:\/\/www.fanbase.app\" target=\"_blank\" rel=\"noreferrer noopener\">Fanbase<\/a> and <a href=\"https:\/\/www.melaninpeople.com\" target=\"_blank\" rel=\"noreferrer noopener\">MelaninPeople<\/a> are seeking to compete with YouTube for Black content creators who often <a href=\"https:\/\/www.bloomberg.com\/news\/features\/2021-03-11\/marketers-are-underpaying-black-influencers-while-pushing-black-lives-matter\" target=\"_blank\" rel=\"noreferrer noopener\">get uncredited and underpaid for viral content<\/a>. <a href=\"https:\/\/www.jointruso.com\" target=\"_blank\" rel=\"noreferrer noopener\">TruSo<\/a> and <a href=\"https:\/\/www.zimela.org\" target=\"_blank\" rel=\"noreferrer noopener\">Zimela<\/a> are vying to compete with Microsoft-owned LinkedIn to cultivate a professional social network. Black-owned wholesale retailers like <a href=\"https:\/\/webuyblack.com\" target=\"_blank\" rel=\"noreferrer noopener\">WeBuyBlack.com<\/a> are seeking to offer more diverse and culturally inclusive products directly from sellers of color around the world. Platforms that carefully curate Black-owned businesses and Black-inspired goods, services, and experiences like <a href=\"https:\/\/www.supportblackowned.com\" target=\"_blank\" rel=\"noreferrer noopener\">Support Black Owned<\/a>, <a href=\"https:\/\/obws.com\" target=\"_blank\" rel=\"noreferrer noopener\">Official Black Wall Street<\/a>, <a href=\"https:\/\/blackownedassociation.com\" target=\"_blank\" rel=\"noreferrer noopener\">Black Owned Association<\/a>, <a href=\"https:\/\/www.blackownedbrooklyn.com\" target=\"_blank\" rel=\"noreferrer noopener\">Black Owned Brooklyn<\/a>, and <a href=\"https:\/\/www.eatokra.com\" target=\"_blank\" rel=\"noreferrer noopener\">EatOkra<\/a> are trying to offer alternatives to <a href=\"https:\/\/www.nytimes.com\/2020\/12\/14\/technology\/how-google-dominates.html\" target=\"_blank\" rel=\"noreferrer noopener\">Google\u2019s ginormous search engine<\/a> and <a href=\"https:\/\/www.nytimes.com\/2021\/03\/30\/technology\/amazon-market-size.html\" target=\"_blank\" rel=\"noreferrer noopener\">Amazon\u2019s mammoth marketplace of everything<\/a>.<\/p>\n\n\n\n<p><strong>And you have likely never heard of these companies because they don\u2019t have wide audiences.<\/strong> None of these promising Black-owned digital platforms have even 1% of \u201c50,000,000 United States-based monthly active users\u201d nor a fraction of \u201c100,000 United States-based monthly active business users\u201d (criteria for \u201ccovered platforms\u201d from the American Innovation and Choice Online Act (\u201cAICO\u201d or <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/2992\" target=\"_blank\" rel=\"noreferrer noopener\">S. 2992<\/a>, Section 2(4)(aa)-(bb)). <a href=\"https:\/\/www.businessofapps.com\/data\/apple-statistics\/\" target=\"_blank\" rel=\"noreferrer noopener\">Apple<\/a>, <a href=\"https:\/\/www.bigcommerce.com\/blog\/amazon-statistics\/#10-fascinating-amazon-statistics-sellers-need-to-know-in-2020\" target=\"_blank\" rel=\"noreferrer noopener\">Amazon<\/a>, <a href=\"https:\/\/websitebuilder.org\/blog\/google-stats\/\" target=\"_blank\" rel=\"noreferrer noopener\">Google<\/a>, and <a href=\"https:\/\/datareportal.com\/essential-facebook-stats\" target=\"_blank\" rel=\"noreferrer noopener\">Meta<\/a>, however, have tens of millions of monthly users and business users <em>over<\/em> the statutory limit on multiple subsidiaries they own. These incumbent platforms erect tall gates to capitalize on the inherent <a href=\"https:\/\/publicknowledge.org\/antoine-prince-albert-iii-on-the-market-structure-of-digital-platforms\/\">network <\/a><a href=\"https:\/\/publicknowledge.org\/antoine-prince-albert-iii-on-the-market-structure-of-digital-platforms\/\" target=\"_blank\" rel=\"noreferrer noopener\">effects<\/a> \u2013 \u201cthe economic phenomenon whereby a product or service gains additional value as more people use it\u201d (<a href=\"https:\/\/www.google.com\/search?q=network+effects+definition&amp;client=firefox-b-1-d&amp;ei=kClgYrb0Md2wptQP39C_mA8&amp;oq=network+effects+def&amp;gs_lcp=Cgdnd3Mtd2l6EAEYADIFCAAQgAQyBQgAEIAEMgYIABAWEB4yBggAEBYQHjIGCAAQFhAeMgYIABAWEB4yBggAEBYQHjIGCAAQFhAeMgYIABAWEB4yBggAEBYQHjoHCAAQRxCwAzoHCAAQsAMQQzoFCC4QgARKBAhBGABKBAhGGABQpARY0Qhg7RFoAXABeACAAVWIAZkCkgEBNJgBAKABAcgBCsABAQ&amp;sclient=gws-wiz\" target=\"_blank\" rel=\"noreferrer noopener\">Google\/Oxford<\/a>). Color of Change explained that the biggest companies are known to monitor relevant markets, then <a href=\"https:\/\/www.youtube.com\/watch?v=vxkDKFKgD5I\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cacquire\u201d and \u201ckill\u201d<\/a> their potential rivals. Big Tech locks out rival products, emerging businesses, and disruptive app features, to lock consumers inside the gates of their walled gardens. Black-owned\/serving <a href=\"https:\/\/www.binnews.com\/content\/2021-07-30-five-black-owned-social-media-sites-you-should-check-out\/\" target=\"_blank\" rel=\"noreferrer noopener\">social networks<\/a>, <a href=\"https:\/\/www.businessoffashion.com\/articles\/retail\/the-new-wave-of-black-owned-marketplaces\/\" target=\"_blank\" rel=\"noreferrer noopener\">online marketplaces<\/a>, and <a href=\"https:\/\/www.gothamgazette.com\/city\/11214-nyc-minority-owned-business-growth-mwbe\" target=\"_blank\" rel=\"noreferrer noopener\">search engines<\/a> struggle to achieve profitability and long-term market viability because they cannot easily reach consumers walled inside incumbent platforms. Consumers cannot easily switch to Black-owned platforms because the <a href=\"https:\/\/blogs.lse.ac.uk\/businessreview\/2019\/09\/24\/how-digital-businesses-can-leverage-the-high-cost-for-consumers-to-switch-platforms\/\" target=\"_blank\" rel=\"noreferrer noopener\">costs of switching<\/a> (<em>e.g.<\/em>, moving photos and memories, re-building friend groups, curating music preferences in new apps) are too high. One of the ways in which these companies have tried to overcome the barriers and reach potential consumers is through buying ads, buying impressions, and creating groups on the very incumbent platforms they want to compete with.<\/p>\n\n\n\n<p><strong>The American Innovation and Choice Online Act targets 10 forms of economic discrimination by covered platforms, including <em>discriminatory<\/em> interoperability. <\/strong>Specifically, the Senate Judiciary Committee included a <em>nondiscriminatory interoperability<\/em> provision, Section 3(a)(4), which gives tech platforms the choice to interoperate with the dominant platforms <em>to the extent<\/em> that the incumbents already allow interoperability among their subsidiary services and other chosen companies. Section 3(a)(4) circles in on how Apple, Amazon, Google, Meta, and Microsoft use <em>selective interoperability<\/em> between their own platforms or with other large digital platforms to lock in consumers while locking out competitors. Meta, for instance, preferences its own product-lines by offering <a href=\"https:\/\/www.facebook.com\/business\/help\/359139904893501?id=526867548205796\" target=\"_blank\" rel=\"noreferrer noopener\">cross-posting<\/a>, centralized <a href=\"https:\/\/about.fb.com\/news\/2020\/09\/new-messaging-features-for-instagram\/\" target=\"_blank\" rel=\"noreferrer noopener\">messaging<\/a> (including <a href=\"https:\/\/www.facebook.com\/business\/tools\/meta-business-suite?content_id=EFYRVL4dPjQ7k86&amp;ref=sem_smb&amp;utm_source=GOOGLE&amp;utm_medium=fbsmbsem&amp;utm_campaign=PFX_SEM_G_BusinessAds_US_EN_Brand_BMM_Desktop&amp;utm_content=FBS-Cross-Post_Evaluating&amp;kenid=_k_Cj0KCQjwjN-SBhCkARIsACsrBz6lzIeMJwpIB1zkYyNxLDfeGohN1xBMoxt3pi73VGejb6yapquAVYQaAmvdEALw_wcB_k_&amp;utm_term=%2Bcross%20%2Bposting%20%2Bfacebook%20%2Binstagram&amp;utm_ct=EVG&amp;gclid=Cj0KCQjwjN-SBhCkARIsACsrBz6lzIeMJwpIB1zkYyNxLDfeGohN1xBMoxt3pi73VGejb6yapquAVYQaAmvdEALw_wcB\" target=\"_blank\" rel=\"noreferrer noopener\">businesses<\/a>), and <a href=\"https:\/\/www.supereasy.com\/how-to-find-facebook-friends-on-instagram\/\" target=\"_blank\" rel=\"noreferrer noopener\">friend-finding<\/a> between Meta-owned Facebook and Instagram. Meta has also elected to interoperate with other <a href=\"https:\/\/www.cnbc.com\/2018\/12\/19\/facebook-gave-amazon-microsoft-netflix-special-access-to-data-nyt.html\" target=\"_blank\" rel=\"noreferrer noopener\">large platforms<\/a>, and these handshakes between giants lock competition out of markets. Google puts its selective interoperability on display with <a href=\"https:\/\/www.seobility.net\/en\/wiki\/Google_OneBox\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cone boxes\u201d<\/a> for common searches. People searching Google for restaurants, hair salons, or local shops see the results on a prominently featured Google Map. People searching for particular products see the <a href=\"https:\/\/support.google.com\/google-ads\/answer\/2454022?hl=en\" target=\"_blank\" rel=\"noreferrer noopener\">Google Shopping Ads<\/a> rotating window above the enumerated results. Google compiles key information from top websites in <a href=\"https:\/\/support.google.com\/knowledgepanel\/answer\/9163198?hl=en\" target=\"_blank\" rel=\"noreferrer noopener\">knowledge panels<\/a> at the right-hand side of the results, but Google <em>selectively<\/em> gives those sources attribution (in really small font at the bottom with spotty hyperlinks). Google searches for <a href=\"https:\/\/support.google.com\/websearch\/answer\/10106608?hl=en\" target=\"_blank\" rel=\"noreferrer noopener\">words and their meanings<\/a> defaults to <a href=\"https:\/\/languages.oup.com\/google-dictionary-en\/\" target=\"_blank\" rel=\"noreferrer noopener\">Oxford Languages<\/a>\u2019 embedded search bar in English. Yet searches for words in Arabic, French, Swahili, Hausa, other French and English-based Creoles \u2013 the other languages most spoken among the African Diaspora \u2013 defaults to Google Translate without an embedded search function. Google hasn\u2019t made their global search tool truly global. Apple, Amazon, and Microsoft also engage in selective interoperability that 3(a)(4) targets. However, interoperability should be more than a leveraging tool to advantage one\u2019s own services or mere handshakes among powerful companies to lock out competitors. Rather, it <a href=\"https:\/\/www.eff.org\/deeplinks\/2018\/07\/facing-facebook-data-portability-and-interoperability-are-anti-monopoly-medicine\" target=\"_blank\" rel=\"noreferrer noopener\">should be a tool<\/a> that lowers barriers of entry for smaller competitors. Businesses can only truly be successful if they control their own destiny.<\/p>\n\n\n\n<p><strong>Once enacted, emerging Black-owned\/serving platforms could advocate for the Federal Trade Commission to enforce nondiscriminatory interoperability and gain access to consumers under Section 3(a)(4). <\/strong>Just as Meta offers cross-posting and cross-messaging between its sister-services, under Section 3(a)(4), <a href=\"https:\/\/www.startengine.com\/fanbase\" target=\"_blank\" rel=\"noreferrer noopener\">Fanbase<\/a> and <a href=\"https:\/\/twitter.com\/melaninpeople\" target=\"_blank\" rel=\"noreferrer noopener\">MelaninPeople<\/a> could argue for nondiscriminatory interoperability with Meta products. <a href=\"https:\/\/later.com\/blog\/black-creators-on-social-media\/\" target=\"_blank\" rel=\"noreferrer noopener\">Black content creators<\/a> on Fanbase and MelaninPeople could then cross-post on Instagram or message users on Facebook, and showcase their brilliant talent to 3 billion monthly active users around the world. Similarly, <a href=\"https:\/\/www.apple.com\/newsroom\/2019\/05\/thousands-of-stories-one-wwdc\/\" target=\"_blank\" rel=\"noreferrer noopener\">Zimela<\/a> and <a href=\"https:\/\/www.youtube.com\/watch?v=QLEzCF9jhDE\" target=\"_blank\" rel=\"noreferrer noopener\">TruSo<\/a> might want to offer interoperability with <a href=\"https:\/\/news.linkedin.com\/about-us#Statistics\" target=\"_blank\" rel=\"noreferrer noopener\">LinkedIn<\/a> so that Black workers can represent their professional projects and lives in more <a href=\"https:\/\/www.harvardbusiness.org\/diversity-inclusion-and-belonging\/\" target=\"_blank\" rel=\"noreferrer noopener\">culturally inclusive<\/a> ways that progress diversity, equity, inclusion, and belonging. If the FTC determined that LinkedIn was a <em>critical trading partner<\/em> (a principal intermediary between business users and individual users) and thus a covered platform, and Zimela and TruSo found that any interoperability between other Microsoft-owned products useful to compete in the market, then Zimela and TruSo could firmly argue that under Section 3(a)(4) Microsoft must make the same capabilities available to them too. Nondiscriminatory interoperability between these platforms would give tens of thousands of subscribers access to the <a href=\"https:\/\/blog.hootsuite.com\/linkedin-statistics-business\/\" target=\"_blank\" rel=\"noreferrer noopener\">58 million companies<\/a> on LinkedIn. And just like Google shows brick-and-mortar results in its proprietary map, <a href=\"https:\/\/www.instagram.com\/blackownedassociation\/?hl=en\" target=\"_blank\" rel=\"noreferrer noopener\">BlackOwnedAssociation.com<\/a> would have the opportunity to display its 1,800 Black-owned shops on its glossier map product, or EatOkra might want to display its 9,500 Black-owned restaurants, eateries, and food trucks nationwide with its own native map featuring little <a href=\"https:\/\/en.wikipedia.org\/wiki\/Okra#\/media\/File:Okra_(Abelmoschus_esculentus)_cross-section_-_20080613.png\" target=\"_blank\" rel=\"noreferrer noopener\">pentagonal Okra pods<\/a>. If Google products and Google affiliates get their chance in the one box, Black-owned businesses and cultural goods should also be readily retrievable for the public. The odds should always be in favor of the best results, not the ones owned or preferred by dominant platforms. Meta, Google, Microsoft, or any of the covered platforms should no longer be allowed to leverage interoperability to advantage their own services and bottom lines. That\u2019s cheating, not competing.<\/p>\n\n\n\n<p><strong>Again, these examples of how AICO\u2019s interoperability provision might work; but how it will actually work depends on the emerging platforms themselves and the FTC and Department of Justice enforcement guidelines. <\/strong>Nascent companies like Fanbase, TruSo, and BlackedOwnedAssociation can go to the FTC, the DOJ, or states\u2019 Attorneys General with concerns about covered platforms discriminating in interoperability under 3(a)(4), or any of the other nine discriminatory practices in Section 3(a).<\/p>\n\n\n\n<p>In sum, <a href=\"https:\/\/www.votervoice.net\/PublicKnowledge\/campaigns\/90832\/respond\" target=\"_blank\" rel=\"noreferrer noopener\">Congress must pass S.2992 &#8211; The American Innovation and Choice Online Act<\/a> to open the largest covered platforms\u2019 networks to newer and smaller platforms like the aforementioned Black-owned\/serving companies.
