Peter Welch (D-VT) introduced the \u201c<a href=\"https:\/\/welch.house.gov\/sites\/welch.house.gov\/files\/Welch%20Section%20Summary%2005.17.22.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Digital Platform Commission Act<\/a>.\u201d The bill would create an independent agency to serve as a digital regulator for the technology sector in order to enhance competition, protect consumers, and promote civic discourse and democracy. The bill follows <a href=\"https:\/\/publicknowledge.org\/public-knowledge-applauds-bill-creating-digital-regulator-to-rein-in-big-tech\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sen. Michael Bennet\u2019s (D-CO) nearly identical bill<\/a> of the same name.<\/p>\n\n\n\n<p>The bill draws on regulatory concepts first articulated by Public Knowledge Senior Vice President Harold Feld in his 2019 book, \u201c<a href=\"https:\/\/www.digitalplatformact.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Case for the Digital Platform Act<\/a>,\u201d as well as advocacy by Public Knowledge President and CEO <a href=\"https:\/\/publicknowledge.org\/a-regulator-to-fit-the-growing-regulatory-consensus\/\" target=\"_blank\" rel=\"noreferrer noopener\">Chris Lewis<\/a>, Public Knowledge Policy Counsel <a href=\"https:\/\/www.youtube.com\/watch?v=y9cZ9zNfHMg&amp;ab_channel=PublicKnowledge\" target=\"_blank\" rel=\"noreferrer noopener\">Alex Petros<\/a>, Competition Policy Director <a href=\"https:\/\/publicknowledge.org\/policy\/public-knowledge-charlotte-slaiman-testimony-before-senate-judiciary-on-big-datas-threat-to-competition\/\" target=\"_blank\" rel=\"noreferrer noopener\">Charlotte Slaiman<\/a>, and former Public Knowledge President <a href=\"https:\/\/publicknowledge.org\/the-right-way-to-regulate-digital-platforms\/\" target=\"_blank\" rel=\"noreferrer noopener\">Gene Kimmelman<\/a>. Public Knowledge commends Rep. Welch for creating a digital regulator to be the \u201ccop on the beat\u201d to serve the public interest and foster a healthier, more competitive digital marketplace.<\/p>\n\n\n\n<p>The following can be attributed to Harold Feld, Senior Vice President at Public Knowledge:<\/p>\n\n\n\n<p>\u201cSince the 19th century, as our economy transitioned through the industrial revolution to the digital age, Congress has recognized the need to create specialized, expert sector-specific regulators to protect consumers by ensuring transparency and accountability. The \u2018Digital Platform Commission Act\u2019 introduced today by Rep. Welch follows in this tradition and is long overdue. The new Digital Platform Commission would have the power to protect consumers from deceptive practices such as \u2018dark patterns,\u2019 examine algorithms for evidence of self-preferencing or unfair practices, and designate significantly important platforms for additional oversight. This is the expert \u2018cop on the beat\u2019 we need.<\/p>\n\n\n\n<p>\u201c<a href=\"https:\/\/publicknowledge.org\/platform-regulation-part-i-why-platform-regulation-is-both-necessary-and-hard\/\" target=\"_blank\" rel=\"noreferrer noopener\">Four years ago<\/a>, Public Knowledge highlighted the increasing importance of digital platforms to our economy, our daily lives, and even our democracy itself and called for rules of the road to protect consumers and promote competition. In 2019, <a href=\"https:\/\/www.digitalplatformact.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">we published a blueprint<\/a> for an agency that would have the expertise and authority to rein in Big Tech and protect the public interest. Since then, we have seen scandal after scandal highlighting how the unique nature of digital platforms allows these unsupervised tech giants to <a href=\"https:\/\/www.inc.com\/jason-aten\/google-is-making-it-harder-to-tell-difference-between-ads-search-results.html\" target=\"_blank\" rel=\"noreferrer noopener\">deceive<\/a> consumers in an <a href=\"https:\/\/www.forbrukerradet.no\/siste-nytt\/amazon-manipulates-customers-to-stay-subscribed\/\" target=\"_blank\" rel=\"noreferrer noopener\">ever<\/a> <a href=\"https:\/\/www.cnn.com\/cnn-underscored\/reviews\/amazon-fake-reviews\">increasing<\/a> <a href=\"https:\/\/m.lasvegassun.com\/news\/2022\/may\/07\/commerce-shift-online-exacerbates-dangers-of-count\/\" target=\"_blank\" rel=\"noreferrer noopener\">number<\/a> <a href=\"https:\/\/www.protocol.com\/policy\/dark-patterns-subscriptions-ftc-amazon\" target=\"_blank\" rel=\"noreferrer noopener\">of ways<\/a>, <a href=\"https:\/\/www.theatlantic.com\/ideas\/archive\/2021\/11\/facebooks-dangerous-experiment-teen-girls\/620767\/\" target=\"_blank\" rel=\"noreferrer noopener\">manipulate users<\/a>, and wield their power to <a href=\"https:\/\/www.congress.gov\/event\/116th-congress\/house-event\/110883\" target=\"_blank\" rel=\"noreferrer noopener\">unfairly crush potential competitors<\/a>. But while the <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/digital-services-act-package\" target=\"_blank\" rel=\"noreferrer noopener\">European Union<\/a> and <a href=\"https:\/\/www.gov.uk\/government\/publications\/digital-regulation-driving-growth-and-unlocking-innovation\/digital-regulation-driving-growth-and-unlocking-innovation\" target=\"_blank\" rel=\"noreferrer noopener\">other countries<\/a> have acted to address the proliferating consumer harms, the United States has remained a step behind.
