{"id":35733,"date":"2023-03-31T15:13:04","date_gmt":"2023-03-31T15:13:04","guid":{"rendered":"https:\/\/publicknowledge.org\/?p=35733"},"modified":"2025-11-22T21:23:15","modified_gmt":"2025-11-22T21:23:15","slug":"public-knowledge-opposes-faulty-journalism-bill-undermining-open-internet-and-free-speech-online","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/public-knowledge-opposes-faulty-journalism-bill-undermining-open-internet-and-free-speech-online\/","title":{"rendered":"Public Knowledge Opposes Faulty &#8216;Journalism\u2019 Bill Undermining Open Internet and Free Speech Online"},"content":{"rendered":"\n<p>Today, Senators Amy Klobuchar (D-MN) along with Dick Durbin (D-IL), Lindsey Graham (R-SC), and other co-sponsors reintroduced the \u201c<a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/senate-bill\/1094\">Journalism Competition and Preservation Act<\/a>.\u201d&nbsp;<\/p>\n\n\n\n<p>The JCPA creates an exemption to antitrust law, which normally prohibits industry collusion on pricing and other business terms. It would allow news organizations to band together into \u201cjoint negotiating entities\u201d to negotiate for payment from dominant digital platforms for \u201caccessing\u201d their content, building up the power of dominant media organizations while also limiting the ability of internet users to share links and discuss the news. Public Knowledge <a href=\"https:\/\/publicknowledge.org\/jcpa-resources\/\">continues to oppose the JCPA<\/a> for jeopardizing both local journalism and the open internet.<\/p>\n\n\n\n<p>The following can be attributed to Lisa Macpherson, Senior Policy Analyst at Public Knowledge:&nbsp;<\/p>\n\n\n\n<p>\u201cPublic Knowledge, along with <a href=\"https:\/\/publicknowledge.org\/strange-bedfellows-why-advocates-still-oppose-the-jcpa\/\">public interest organizations from across the political spectrum<\/a>, have opposed the JCPA for over three years. We recognize the crisis in local news and advocate for policy solutions to address it. But the use of an elaborate antitrust exemption like that in the JCPA will only serve to compound the biggest challenges in our news and information landscape: consolidation of power, distance and disengagement of news conglomerate owners from the communities they serve, and the rampant spread of misinformation on the internet.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cJCPA supporters <a href=\"https:\/\/www.nytimes.com\/2023\/03\/30\/business\/media\/publishers-chatbots-search-engines.html\">now point to AI<\/a> as a new justification for their failed bill from the last Congress. The advent of generative AI models like Bing Chat and Google\u2019s Bard may require a policy response to meet new challenges in that landscape.
