{"id":36388,"date":"2023-11-15T16:26:31","date_gmt":"2023-11-15T16:26:31","guid":{"rendered":"https:\/\/publicknowledge.org\/?p=36388"},"modified":"2023-11-15T16:26:33","modified_gmt":"2023-11-15T16:26:33","slug":"public-knowledge-hails-landmark-fcc-rules-ending-digital-discrimination","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/public-knowledge-hails-landmark-fcc-rules-ending-digital-discrimination\/","title":{"rendered":"Public Knowledge Hails Landmark FCC Rules Ending Digital Discrimination"},"content":{"rendered":"\n<p>Today, the Federal Communications Commission voted to approve a <a href=\"https:\/\/www.fcc.gov\/document\/preventing-digital-discrimination-broadband-internet-access\">Report and Order and Further Notice of Proposed Rulemaking<\/a> to set rules to end digital discrimination and promote equal access to broadband.<\/p>\n\n\n\n<p>The bipartisan \u201c<a href=\"https:\/\/publicknowledge.org\/house-passage-of-infrastructure-package-moves-to-close-the-digital-divide\/\">Infrastructure Investment and Jobs Act of 2021<\/a>\u201d requires the FCC to adopt rules to prevent broadband providers from discriminating on the basis of \u201cincome level, race, ethnicity, color or national origin.\u201d Congress adopted this provision in response to <a href=\"https:\/\/www.cnet.com\/home\/internet\/features\/the-broadband-gaps-dirty-secret-redlining-still-exists-in-digital-form\/\">numerous<\/a> <a href=\"https:\/\/themarkup.org\/still-loading\/2022\/10\/19\/dollars-to-megabits-you-may-be-paying-400-times-as-much-as-your-neighbor-for-internet-service\">reports<\/a> that ISPs investing millions to deploy fiber were refusing to invest in low-income neighborhoods and communities of color. The statute requires the FCC to issue final rules by this month.<\/p>\n\n\n\n<p>Public Knowledge has <a href=\"https:\/\/publicknowledge.org\/public-knowledge-urges-fcc-to-swiftly-and-forcefully-address-digital-discrimination\/\">urged the FCC to adopt strong rules<\/a> and to use the disparate impact standard. Public Knowledge is pleased to see the Commission adopt the disparate impact standard and a strong overall framework for future enforcement.<\/p>\n\n\n\n<p>The following can be attributed to Harold Feld, Senior Vice President at Public Knowledge:<\/p>\n\n\n\n<p>\u201cTwo years ago, Congress <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/47\/1701\">explicitly found<\/a> that \u2018the digital digital divide disproportionately affects communities of color, lower-income areas\u2026 and [that] the benefits of broadband should be broadly enjoyed by all.\u2019 In response, Congress swiftly moved to fight <a href=\"https:\/\/publicknowledge.org\/policy\/one-pager-on-digital-redlining\/\">digital redlining<\/a> \u2013 the practice of broadband providers systemically underinvesting in communities of color and lower-income communities \u2013 by requiring the FCC to create rules ending this behavior by November 15, 2023.<\/p>\n\n\n\n<p>\u201cToday, the FCC adopts a framework that enacts this promise for the American people. With vigorous enforcement, today\u2019s rules will <a href=\"https:\/\/connectyourcommunity.org\/fcc-broadband-data-poorer-cuyahoga-neighborhoods-are-still-likeliest-to-get-old-slow-att-service\/\">connect more families denied high-speed broadband access<\/a> simply because of who they are and where they live. We commend the FCC for taking yet another step toward closing the digital divide so that more people can benefit from broadband, a service essential for our modern lives. We applaud Chair Rosenworcel for her commitment to, in the words of the statute, \u2018ensuring that all people of the United States benefit from equal access to broadband.\u2019<\/p>\n\n\n\n<p>\u201cBut while these rules create a strong framework, nothing will change without vigorous enforcement.
