Missouri Could Help \u2013 or Hinder \u2013 Democracy Next Year"},"content":{"rendered":"\n<p>In August, Public Knowledge <a href=\"https:\/\/twitter.com\/publicknowledge\/status\/1701342681350193219?s=20\">published<\/a> a <a href=\"https:\/\/publicknowledge.org\/missouri-v-biden-could-mean-worse-content-moderation\/\">perspective<\/a> on <em>Missouri v. Biden<\/em>, a lawsuit brought by the attorneys general of Louisiana and Missouri arguing that the Biden administration improperly coordinated with social media companies to censor conservative viewpoints under the guise of anti-misinformation campaigns. Our position is that while we must ensure that platforms are not under undue or inappropriate pressure from the government, decisions that restrict informed, independent, and responsible content moderation will likely lead to the further deterioration of our information ecosystem.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The case has seen several twists and turns since then, and they show more clearly the plaintiffs\u2019 intent. As background: Based on an analysis colorfully <a href=\"https:\/\/knightcolumbia.org\/content\/knight-institute-comments-on-fifth-circuit-ruling-in-missouri-v-biden\">described<\/a> by a prominent First Amendment scholar as \u201ca dog\u2019s breakfast,\u201d in early September the Fifth U.S. Circuit Court of Appeals upheld but also significantly narrowed a lower court\u2019s injunction freezing communications between social media companies and large swaths of the federal government. The Fifth Circuit decision meant, among other things, that <em>only<\/em> the White House, the Surgeon General, the CDC, and the FBI were subject to the preliminary injunction.&nbsp;<\/p>\n\n\n\n<p>The plaintiffs quickly <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A243\/280417\/20230925163344188_2023-09-25%20-%20Letter%20to%20U.S.%20Supreme%20Court%20re%20Panel%20Rehearing%20in%20Fifth%20Circuit-FINAL-updated.pdf\">asked<\/a> the Fifth Circuit to revisit its decision. In particular, they wanted the court to maintain the preliminary injunction against the Cybersecurity and Infrastructure Security Agency (CISA) and the State Department\u2019s Global Engagement Center, and the prohibition against federal officials collaborating with the Election Integrity Partnership (EIP). What do these particular organizations have in common? They work to protect election information integrity. The appeals court <a href=\"https:\/\/regmedia.co.uk\/2023\/10\/04\/missouri-v-biden-october-modification.pdf\">substituted<\/a> an opinion in which CISA &#8211; and <em>only<\/em> CISA &#8211; was additionally subject to the Louisiana court\u2019s preliminary injunction. It did not explain why it had <a href=\"https:\/\/www.techdirt.com\/2023\/10\/04\/5th-circuit-continues-to-5th-circuit-issues-yet-another-version-of-its-injunction-this-time-including-cisa\/\">changed its mind<\/a>.&nbsp;<\/p>\n\n\n\n<p>The Supreme Court, having already issued and extended a stay on the previous version of the modified order, <a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/23a243.html\">granted<\/a> a temporary stay on this one, as well. It was a response to an <a href=\"https:\/\/s3.documentcloud.org\/documents\/23977752\/23a243.pdf\">application<\/a> from the Solicitor General, on behalf of Surgeon General Vivek H. Murthy, that described the lower court&#8217;s actions as \u201cnovel,\u201d \u201cunbounded,\u201d \u201cstartling,\u201d \u201cradical,\u201d and \u201cill-defined\u201d (among other things). Justices Alito, Thomas, and Gorsuch dissented.&nbsp;<\/p>\n\n\n\n<p>The Supreme Court subsequently agreed to hear what is now <em>Murthy v. Missouri<\/em> during its 2023\u201324 term. The Court also lifted the injunction, which means <em>all <\/em>federal agencies can continue to collaborate with social media platforms to inform their content moderation policies and procedures. <strong>We hope the Supreme Court\u2019s eventual decision will preserve these freedoms. <\/strong>Again, although we agree platforms must not be inappropriately pressured by the government, collaboration with specialized agencies with distinct expertise and information is necessary to ensure informed content moderation in the public interest.&nbsp;<\/p>\n\n\n\n<p>In our view, this case is about much more than past content moderation decisions in regard to the pandemic and<a href=\"https:\/\/en.wikipedia.org\/wiki\/Hunter_Biden_laptop_controversy\"> Hunter Biden\u2019s laptop<\/a>. One year out from the next national election, motivated plaintiffs are determinedly asking courts to disallow government national security agencies from collaborating with researchers whose <a href=\"https:\/\/www.eipartnership.net\/report\">stated aims<\/a> are to \u201cstrengthen platform standards for combating election-related misinformation.\u201d We believe the plaintiffs\u2019 aim is to use every political and legal tool at their disposal to preserve the ability to use networked disinformation as a political strategy.<\/p>\n\n\n\n<p>In fact, the Supreme Court case is only one manifestation of an orchestrated effort to equate government collaboration with platforms with \u201ccensorship,\u201d in the interest of chilling platform content moderation and academic research about it. Documents from the discovery process in <em>Missouri v. Biden <\/em>have been the basis of <a href=\"https:\/\/judiciary.house.gov\/committee-activity\/hearings\/hearing-weaponization-federal-government-3\">hearings<\/a> and <a href=\"https:\/\/judiciary.house.gov\/documents\/letters\">angry letters<\/a> from legislators making the <a href=\"https:\/\/static1.squarespace.com\/static\/5b6df958f8370af3217d4178\/t\/60187b5f45762e708708c8e9\/1612217185240\/NYU+False+Accusation_2.pdf\">discredited<\/a> point that informed platform content moderation represents targeted suppression of conservative political viewpoints. The impact on election information integrity efforts has been <a href=\"https:\/\/www.nbcnews.com\/tech\/tech-news\/gop-muzzled-quiet-coalition-fought-foreign-propaganda-rcna103373?utm_source=substack&amp;utm_medium=email\">well-documented<\/a>: stalled coordination, reductions in research investments, and chilling of platform content moderation that will increase the likelihood of either foreign or domestic manipulation of U.S. elections. Now new philanthropic <a href=\"https:\/\/knightcolumbia.org\/content\/knight-institute-to-provide-new-legal-support-to-researchers-studying-online-platforms\">funds are starting up<\/a> to provide researchers who receive subpoenas for information relating to their research with legal advice.<br><br>Taken together, as one <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S2352250X23001562\">recent research paper<\/a> noted, \u201c&#8230;it is difficult to avoid the realization that one side of politics \u2013 mainly in the U.S. but also elsewhere \u2013 appears more threatened by research into misinformation than by the risks to democracy arising from misinformation itself.\u201d\u00a0 The Supreme Court\u2019s decision in <em>Murthy v.
