{"id":36797,"date":"2024-04-18T19:14:39","date_gmt":"2024-04-18T19:14:39","guid":{"rendered":"https:\/\/publicknowledge.org\/?p=36797"},"modified":"2024-04-18T19:14:42","modified_gmt":"2024-04-18T19:14:42","slug":"the-debate-about-journalism-preservation-just-got-more-confusing","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/the-debate-about-journalism-preservation-just-got-more-confusing\/","title":{"rendered":"The Debate About \u201cJournalism Preservation\u201d Just Got More Confusing"},"content":{"rendered":"\n<p>The ongoing, multinational debate about so-called \u201ccollective bargaining\u201d requirements between dominant digital platforms and news publishers can be downright dizzying. It goes like this:<\/p>\n\n\n\n<p>Publishers: &#8220;You are stealing from us by linking to our content without paying!&#8221;<\/p>\n\n\n\n<p>Platforms: &#8220;Fine. We won&#8217;t link to your content.&#8221;<\/p>\n\n\n\n<p>Publishers: &#8220;No! You <em>have<\/em> to link to our content!\u201d<\/p>\n\n\n\n<p>This debate occurred in <a href=\"https:\/\/www.niemanlab.org\/2022\/06\/after-8-years-google-news-returns-to-spain\/\">Spain<\/a> (where it went on for eight years); again in <a href=\"https:\/\/www.engadget.com\/2019-09-26-google-removes-news-snippets-in-france.html\">France<\/a>; is being threatened in <a href=\"https:\/\/pressgazette.co.uk\/media_law\/online-news-act-canada\/\">Canada<\/a>; may arise in <a href=\"https:\/\/www.theguardian.com\/media\/2024\/mar\/14\/meta-facebook-news-media-bargaining-code#:~:text=The%20government%20is%20now%20working,10%25%20of%20its%20Australian%20revenue.\">Australia<\/a>; and is now on our shores, in California. Last week, in anticipation of a June state Senate vote on the California Journalism Preservation Act \u2013 which requires payment of a \u201cjournalism usage fee\u201d to news publishers \u2013 Google <a href=\"https:\/\/blog.google\/products\/news\/california-journalism-preservation-act-puts-news-ecosystem-at-risk\/\">announced<\/a> it was removing links to California news sites for a small percentage of California users. In response, the News\/Media Alliance, the primary lobbying group for the bill, <a href=\"https:\/\/www.newsmediaalliance.org\/release-news-media-alliance-calls-on-justice-department-california-attorney-general-to-open-investigation-into-googles-blocking-of-news-in-california\/\">sent letters<\/a> to the U.S. Department of Justice, the Federal Trade Commission, and the California State Attorney General, arguing that Google \u201ccould be\u201d violating a whole bunch of laws at both the federal and state levels by not linking to their content.&nbsp;<\/p>\n\n\n\n<p>The California Journalism Preservation Act, or <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240AB886\">CJPA<\/a>, is a twist on the federal Journalism Competition &amp; Preservation Act, about which Public Knowledge has <a href=\"https:\/\/publicknowledge.org\/jcpa-resources\/\">written a lot<\/a>. What the two bills have in common is that they <em>both<\/em> would force dominant digital platforms to pay for linking to news (i.e., \u201cyou are stealing from us\u201d). You know, <em>links<\/em>, those things that <em>make the whole darn internet run <\/em>and allow you, and friends and family and students and news reporters and small businesses and social services agencies and activists and governments, to freely \u2013 literally, for the most part,<em> freely<\/em> \u2013 find and share information. That includes news publishers, who post their stories on their social media pages; optimize their content so it ranks highly on search engines; and already have tools like robots.txt to keep their content from being accessed and indexed by platforms if they don\u2019t want it to be. But they don\u2019t use these tools, by and large, because <em>the traffic from those links is just too valuable to lose. <\/em>When the platforms themselves choose not to link to news content (\u201cfine, we won\u2019t link to your content\u201d), news lobbyists threaten legal action (\u201cyou have to link to our content\u201d).&nbsp;<\/p>\n\n\n\n<p>Isn\u2019t that confusing?<\/p>\n\n\n\n<p>The premise the News\/Media Alliance is pushing \u2013 despite years of contrary jurisprudence \u2013 is that unpaid links to news ought to be a violation of copyright law. We and many others \u2013 like, for example, the U.S. <a href=\"https:\/\/www.copyright.gov\/policy\/publishersprotections\/202206-Publishers-Protections-Study.pdf\">Copyright Office<\/a> \u2013 <a href=\"https:\/\/publicknowledge.org\/we-can-save-local-news-without-upending-copyright-law\/\">disagree<\/a> that expanding copyright is the solution for the crisis in local news. We\u2019ve <a href=\"https:\/\/publicknowledge.org\/policy\/go-local-combating-misinformation-through-media-policy-promoting-localism-and-diversity\/\">written a lot<\/a> about alternative solutions, too.<\/p>\n\n\n\n<p>Not all news publishers are making this case. While the News\/Media Alliance is lobbying on behalf of its Big Media members for laws that force payment from platforms, a wide range of small and diverse publishers are lobbying against them. <a href=\"https:\/\/www.lionpublishers.com\/a-letter-to-lion-members-about-the-journalism-competition-preservation-act-and-the-online-news-act\/\">Local independent news publishers<\/a>, <a href=\"https:\/\/nnpa.org\/op-ed-proposed-journalism-competition-preservation-act-negative-impact-on-small-minority-owned-newspapers\/\">Black newspapers<\/a>, <a href=\"https:\/\/jweekly.com\/2024\/04\/15\/this-bill-could-harm-the-cause-of-good-journalism-in-california\/\">Jewish community news publishers<\/a> in California, and many others agree that these laws will primarily advantage hedge fund owners, national news outlets, and clickbait purveyors, and <em>do nothing to nurture the most promising community-focused sources of news<\/em>.<br><br>We have other concerns with the JCPA and the CJPA (again, <a href=\"https:\/\/publicknowledge.org\/jcpa-resources\/\">see here<\/a>) but one is paramount: <strong>The introduction of a requirement to pay for linking to information on the Open Internet is contrary to the notion of equitable access to knowledge<\/strong>.
