{"id":36842,"date":"2024-04-25T16:09:15","date_gmt":"2024-04-25T16:09:15","guid":{"rendered":"https:\/\/publicknowledge.org\/?p=36842"},"modified":"2025-02-20T20:18:09","modified_gmt":"2025-02-20T20:18:09","slug":"public-knowledge-applauds-fcc-move-restoring-agencys-broadband-authority-net-neutrality-rules","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/public-knowledge-applauds-fcc-move-restoring-agencys-broadband-authority-net-neutrality-rules\/","title":{"rendered":"Public Knowledge Applauds FCC Move Restoring Agency\u2019s Broadband Authority, Net Neutrality Rules"},"content":{"rendered":"\n<p>Today, the Federal Communications Commission voted to approve a <a href=\"https:\/\/www.fcc.gov\/document\/promoting-fast-open-and-fair-internet\" target=\"_blank\" rel=\"noreferrer noopener\">Declaratory Ruling, Order, Report and Order, and Order on Reconsideration<\/a> that would reinstate the agency\u2019s classification of broadband service as \u201ctelecommunications\u201d \u2013 reopening the door for many important consumer protections that put people first, including strong net neutrality rules. Public Knowledge commends the FCC for moving to restore <a href=\"https:\/\/publicknowledge.org\/net-neutrality-resources\/\" target=\"_blank\" rel=\"noreferrer noopener\">net neutrality<\/a> as well as for creating the proper authority allowing for commonsense consumer protections for broadband users.<\/p>\n\n\n\n<p>The FCC previously classified broadband as \u201ctelecommunications\u201d in 2015 as part of the agency\u2019s <a href=\"https:\/\/publicknowledge.org\/public-knowledge-commends-fcc-for-adopting-landmark-net-neutrality-rules\/\" target=\"_blank\" rel=\"noreferrer noopener\">Open Internet Order<\/a>, which enacted net neutrality rules barring broadband providers from throttling connection speeds, blocking websites, and accepting payment for prioritizing traffic. Millions of Americans <a href=\"http:\/\/www.theverge.com\/2014\/9\/16\/6257887\/fcc-net-neutrality-3-7-million-comments-made\" target=\"_blank\" rel=\"noreferrer noopener\">expressed support for these rules<\/a> by submitting comments with the FCC, but the agency, under the leadership of Chairman Ajit Pai, changed course in its unpopular <a href=\"https:\/\/publicknowledge.org\/fcc-abandons-consumer-protection-responsibility-with-net-neutrality-repeal\/\" target=\"_blank\" rel=\"noreferrer noopener\">2017 repeal<\/a>, which abdicated FCC authority over broadband completely \u2013 an unprecedented move that left many consumers vulnerable to deteriorating broadband lines that have not been maintained or upgraded, network traffic being blocked or throttled, and rising prices due to reduced broadband and online competition.<\/p>\n\n\n\n<p>The following can be attributed to John Bergmayer, Legal Director at Public Knowledge:<\/p>\n\n\n\n<p>\u201cToday, the FCC voted to restore the net neutrality rules that were put into place in 2015, and later repealed. Restoring what we had before is an important victory, but just the beginning.<\/p>\n\n\n\n<p>\u201cAs we said when the FCC published its <a href=\"https:\/\/publicknowledge.org\/fcc-set-to-reinstate-title-ii-authority-ensuring-a-free-and-open-internet\/\" target=\"_blank\" rel=\"noreferrer noopener\">draft Order<\/a>, Title II is about much more than just net neutrality. It&#8217;s the foundation of FCC authority for broadband generally, and will help the agency promote <a href=\"https:\/\/publicknowledge.org\/policy\/how-title-ii-strengthens-national-security-and-public-safety-one-pager\/\" target=\"_blank\" rel=\"noreferrer noopener\">public safety and national security<\/a>; ensure <a href=\"https:\/\/publicknowledge.org\/policy\/how-title-ii-supports-internet-reliability-quality-and-resilience-for-all-one-pager\/\" target=\"_blank\" rel=\"noreferrer noopener\">resilient and reliable networks<\/a>; combat <a href=\"https:\/\/publicknowledge.org\/policy\/how-title-ii-helps-fight-digital-discrimination\/\" target=\"_blank\" rel=\"noreferrer noopener\">digital discrimination<\/a>; and promote <a href=\"https:\/\/publicknowledge.org\/policy\/how-title-ii-promotes-a-competitive-affordable-broadband-market-one-pager\/\" target=\"_blank\" rel=\"noreferrer noopener\">competition and affordable service<\/a>. Now the FCC needs to act on these priorities.&nbsp;<\/p>\n\n\n\n<p>\u201cBroadband providers will continue attempting to re-brand their old plans for internet fast and slow lanes, hoping to sneak them through. The FCC will need to diligently enforce its rules, including clarifying that discrimination in favor of certain apps or categories of traffic \u2018impairs\u2019 and \u2018degrades\u2019 traffic that is left in the slow lane, and that broadband providers cannot simply take apps that people use on the internet every day and package them as a separate \u2018non-broadband\u2019 service. The FCC must also ensure that practices that are not expressly prohibited but still unreasonably interfere with the ability of end users to freely use the internet, or of edge providers to freely compete, are disallowed. These practices include discriminatory zero-rating and network interconnection practices.<\/p>\n\n\n\n<p>\u201cOf course, internet service providers will also challenge these rules in court, even though these same rules have already been upheld. We are ready to defend these rules again, and once again affirm the FCC&#8217;s authority to oversee the broadband industry on behalf of the public.<\/p>\n\n\n\n<p>\u201cBut the FCC is not the only way to protect broadband consumers. The FCC has left in place significant state authority over broadband, and states and the federal government can work in parallel to protect broadband users. States with excellent net neutrality and broadband consumer protection statutes, like <a href=\"https:\/\/en.wikipedia.org\/wiki\/California_Internet_Consumer_Protection_and_Net_Neutrality_Act_of_2018\" target=\"_blank\" rel=\"noreferrer noopener\">California<\/a>, can be a nationwide model for other states and the FCC to adopt to strengthen their own rules.
