Zoe Lofgren (D-CA) introduced the \u201c<a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/791\">Foreign Anti-Digital Piracy Act<\/a>\u201d (FADPA) which would allow rightsholders to secure \u201cblocking orders\u201d against foreign websites accused of copyright infringement. Public Knowledge opposes this bill and any site-blocking bill that turns broadband providers into copyright police at Americans\u2019 expense.<\/p>\n\n\n\n<p>The following can be attributed to Meredith Rose, Senior Policy Counsel at Public Knowledge:&nbsp;<\/p>\n\n\n\n<p>\u201cRather than attacking the problem at its source \u2013 bringing the people running overseas piracy websites to court \u2013 Congress and its allies in the entertainment industry has decided to build out a sweeping infrastructure for censorship. Site-blocking orders force any service provider, from residential broadband providers to global DNS resolvers, to disrupt traffic from targeted websites accused of copyright infringement. More importantly, applying blocking orders to global DNS resolvers results in <em>global blocks.<\/em> This means that one court can cut off access to a website globally, based on one individual\u2019s filing and an expedited procedure. Blocking orders are incredibly powerful weapons, ripe for abuse, and we\u2019ve seen the <a href=\"https:\/\/blog.cloudflare.com\/consequences-of-ip-blocking\/\">messy<\/a> <a href=\"https:\/\/www.internetsociety.org\/resources\/internet-fragmentation\/sonys-case-against-quad9\/\">consequences<\/a> of them being <a href=\"https:\/\/project-disco.org\/european-union\/italys-piracy-shield-lessons-learned-and-mistakes-to-avoid\/\">implemented<\/a> in <a href=\"https:\/\/www.eff.org\/deeplinks\/2021\/02\/indonesias-proposed-online-intermediary-regulation-may-be-most-repressive-yet\">other<\/a> <a href=\"https:\/\/torrentfreak.com\/tech-industry-urges-eu-to-halt-italys-overreaching-anti-piracy-measures-250122\/\">countries<\/a>.&nbsp;<\/p>\n\n\n\n<p>\u201cThe entertainment industry already has unprecedented power to control Americans\u2019 access to the internet; they have the legal authority to force internet service providers to disconnect subscribers based on mere <em>accusations <\/em>of copyright infringement. The RIAA can pull the plug on any American\u2019s internet access, at any time, without ever setting foot inside a courtroom. And <em>if<\/em> broadband providers push back, they can look forward to a <a href=\"https:\/\/www.theverge.com\/2024\/7\/15\/24199236\/verizon-music-copyright-infringement-lawsuit-2-6-billion\">$2.6 billion lawsuit<\/a>, courtesy of the recording industry. That kind of power has absolutely no place in an America where the federal government is <a href=\"https:\/\/broadbandusa.ntia.doc.gov\/funding-programs\/broadband-equity-access-and-deployment-bead-program#:~:text=Overview,infrastructure%20deployment%20and%20adoption%20programs.\">spending over $40 billion<\/a> to connect <em>more<\/em> Americans \u2013 while the entertainment industry is fighting to let <em>fewer<\/em> people online, and to police what they can see when they <em>do<\/em> log on.<\/p>\n\n\n\n<p>\u201cInfrastructure and utility providers are not the police force for the entertainment industry.
