{"id":38145,"date":"2025-07-17T12:52:57","date_gmt":"2025-07-17T12:52:57","guid":{"rendered":"https:\/\/publicknowledge.org\/?p=38145"},"modified":"2025-07-22T14:34:56","modified_gmt":"2025-07-22T14:34:56","slug":"public-knowledge-joins-21-groups-urging-fcc-chairman-carr-to-follow-the-law-stop-undermining-agencys-power","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/public-knowledge-joins-21-groups-urging-fcc-chairman-carr-to-follow-the-law-stop-undermining-agencys-power\/","title":{"rendered":"Public Knowledge Joins 21 Groups Urging FCC Chairman Carr To Follow the Law, Stop Undermining Agency\u2019s Power"},"content":{"rendered":"\n<p>Today, Public Knowledge joined 21 other public interest, civil rights, labor, and digital rights groups in a <a href=\"https:\/\/publicknowledge.org\/policy\/group-letter-to-chairman-carr-on-direct-final-rule\/\">letter<\/a> urging Federal Communications Commission Chairman Brendan Carr to pull an item from the agency\u2019s <a href=\"https:\/\/www.fcc.gov\/July2025\">July Open Meeting agenda<\/a> for violating the Administrative Procedure Act. The groups express \u201cgrave concern\u201d regarding \u201cthe adoption by the Commission of a procedure to permit the offices and bureaus to eliminate existing rules without traditional notice-and-comment rulemaking under the \u2018good cause\u2019 exception of the Administrative Procedure Act.\u201d They argue that \u201cthe procedure the FCC would eliminate or relax critical safeguards proposed by the Administrative Conference of the United States to prevent abuse.\u201d The letter asks Chairman Carr to withdraw the current draft of the item.<\/p>\n\n\n\n<p>The following is an excerpt from the letter:<\/p>\n\n\n\n<p>\u201c[T]his [proposed <a href=\"https:\/\/www.fcc.gov\/document\/streamlined-repeal-outdated-and-obsolete-rules\">Direct Final Rule<\/a>] procedure would effectively eliminate any hope for timely judicial review of elimination of a rule on delegated authority \u2013 a result not intended by the Administrative Conference of the United States [that runs] contrary to the intent of the APA and principles of fundamental fairness.<\/p>\n\n\n\n<p>\u201cThis item represents a delegation of authority well beyond anything contemplated by the Communications Act, and completely at odds with the importance of public comment emphasized by the APA and the Supreme Court. It undermines the structure of the Commission as an independent, bipartisan agency, and places unprecedented power in the hands of the Chair through the Chair\u2019s control of the bureaus. It would permit the bureaus to select and eliminate rules through an accelerated process, without publication in the Federal Register. As a result, impacted parties will have little opportunity to advise the Bureau that supposedly \u2018obsolete\u2019 rules remain in use and necessary in the public interest.<\/p>\n\n\n\n<p>\u201cWe therefore strongly urge that you pull the item from the agenda or, at a minimum, do not delegate authority to the bureaus to eliminate rules through Direct Final Rule.
