{"id":38207,"date":"2025-08-08T16:02:02","date_gmt":"2025-08-08T16:02:02","guid":{"rendered":"https:\/\/publicknowledge.org\/?p=38207"},"modified":"2025-08-08T16:02:06","modified_gmt":"2025-08-08T16:02:06","slug":"public-interest-groups-decline-to-seek-supreme-court-review-of-fcc-open-internet-rules","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/public-interest-groups-decline-to-seek-supreme-court-review-of-fcc-open-internet-rules\/","title":{"rendered":"Public Interest Groups Decline To Seek Supreme Court Review of FCC Open Internet Rules"},"content":{"rendered":"\n<p>Today, Public Knowledge joined the Benton Institute for Broadband &amp; Society, Free Press, and New America\u2019s Open Technology Institute to announce a decision not to file a petition for <em>certiorari<\/em> seeking U.S. Supreme Court review of a <a href=\"https:\/\/publicknowledge.org\/sixth-circuit-ruling-on-fcc-authority-threatens-consumer-protections-and-open-internet\/\">lower court decision<\/a> that struck down federal <a href=\"https:\/\/publicknowledge.org\/issue\/net-neutrality\/\">Net Neutrality<\/a> rules. The overturned Federal Communications Commission decision had also classified broadband internet-access services under Title II of the Communications Act.&nbsp;<\/p>\n\n\n\n<p>In April 2024, the Federal Communications Commission during the Biden administration properly <a href=\"https:\/\/publicknowledge.org\/public-knowledge-applauds-fcc-move-restoring-agencys-broadband-authority-net-neutrality-rules\/\">declared<\/a> that broadband internet access is a \u201ctelecommunications service.\u201d That restored the agency\u2019s jurisdiction over these crucial connections, allowing it to hold powerful companies accountable for providing internet-access service on just, reasonable, and nondiscriminatory terms. The FCC at that time also reinstated its Net Neutrality rules, and made allowance for a wide range of consumer protections to improve <a href=\"https:\/\/publicknowledge.org\/policy\/how-title-ii-strengthens-national-security-and-public-safety-one-pager\/\">public safety<\/a>, <a href=\"https:\/\/publicknowledge.org\/policy\/how-title-ii-supports-internet-reliability-quality-and-resilience-for-all-one-pager\/\">broadband reliability<\/a>, and <a href=\"https:\/\/publicknowledge.org\/policy\/how-title-ii-promotes-a-competitive-affordable-broadband-market-one-pager\/\">internet affordability<\/a>.<\/p>\n\n\n\n<p>Predictably, the cable and phone industries filed suit over the legal definitions at issue in the case, and on the demonstrably false premise that these commonsense rules harmed their investment in broadband infrastructure. The public interest groups intervened in the appellate case to defend the FCC\u2019s decisions. The organizations <a href=\"https:\/\/publicknowledge.org\/policy\/net-neutrality-public-interest-intervenors-brief\/\">filed a brief<\/a> in September 2024 (along with the National Association of Regulatory Utility Commissioners) and then took part in oral argument before the Sixth U.S. Circuit Court of Appeals in October.<\/p>\n\n\n\n<p>In January 2025, that court <a href=\"https:\/\/publicknowledge.org\/sixth-circuit-ruling-on-fcc-authority-threatens-consumer-protections-and-open-internet\/\">overturned the FCC\u2019s decision<\/a> on the basis of unprecedented legal grounds and flawed technological arguments. Over the past quarter century, jurists including Supreme Court Justice Antonin Scalia and appeals-court judges in other circuits typically understood that broadband is a telecommunications service offering the basic function of transmitting data for its customers. The Sixth Circuit wrongly held that broadband is what the law calls an \u201cinformation service,\u201d which is subject to far less stringent FCC safeguards. The time period for intervenors to seek Supreme Court review of this decision ended on Aug. 8, 2025.<\/p>\n\n\n\n<p>The following can be attributed to John Bergmayer, Legal Director at Public Knowledge:<\/p>\n\n\n\n<p>\u201cWe are looking forward to continuing to fight for affordable broadband and consumer protection in the states, and to secure a strong legal foundation for broadband oversight at the federal level. We\u2019re disappointed in the outcome of this litigation, but the fight for just and equitable broadband for all is not over.\u201d<\/p>\n\n\n\n<p>The following can be attributed to Andrew Jay Schwartzman, Senior Counselor of the Benton Institute for Broadband &amp; Society:<\/p>\n\n\n\n<p>\u201cThe Sixth Circuit decision makes bad policy as well as bad law. Because it is at odds with the holdings of two other circuits, we expect to take the issue to the Supreme Court in a future case.\u201d<\/p>\n\n\n\n<p>The following can be attributed to Matt Wood, Vice President of Policy and General Counsel at Free Press:<\/p>\n\n\n\n<p>\u201cIt\u2019s often said that elections have consequences, and so do the agency and judicial appointments the winners make. But no matter their politics, people in America really don\u2019t trust their ISPs. Federal rules safeguarding internet openness, reliability and affordability are just as vital today as always, despite what cable lobbyists and their paid pundits claim. Yet Trump\u2019s election flipped the FCC majority back to ideologues who\u2019ve always taken the broadband industry\u2019s side on this crucial issue. And the justices making up the current Supreme Court majority have shown hostility toward sound legal reasoning on this precise question and a host of other topics too.<\/p>\n\n\n\n<p>\u201cThe Sixth Circuit\u2019s decision earlier this year was spectacularly wrong, and the protections it struck down are extremely important. But rather than attempting to overcome an agency that changed hands \u2013 and a Supreme Court majority that cares very little about the rule of law \u2013 we\u2019ll keep fighting for internet affordability and openness in Congress, state legislatures and other court proceedings nationwide.\u201d<\/p>\n\n\n\n<p>The following can be attributed to Raza Panjwani, Senior Policy Counsel at New America\u2019s Open Technology Institute:<\/p>\n\n\n\n<p>\u201cPublic interest advocates have been arguing for basic consumer protections and meaningful oversight of broadband internet access service for more than 20 years now. Throughout that time, internet service providers have refused to accept these commonsense measures \u2013 and their justifications haven\u2019t gotten any more compelling. What has changed is the increasingly antagonistic approach our federal courts are taking to laws and regulations that hold corporations accountable, with judges across the country now ruling that our government is essentially powerless to protect consumers from predatory business practices.
