{"id":5130,"date":"2017-07-17T20:02:00","date_gmt":"2017-07-17T20:02:00","guid":{"rendered":"http:\/\/www.publicknowledge.org\/press-release\/public-knowledge-files-fcc-comments-to-preserve-net-neutrality-rules\/"},"modified":"2024-12-11T20:03:18","modified_gmt":"2024-12-11T20:03:18","slug":"public-knowledge-files-fcc-comments-to-preserve-net-neutrality-rules","status":"publish","type":"post","link":"https:\/\/publicknowledge.org\/public-knowledge-files-fcc-comments-to-preserve-net-neutrality-rules\/","title":{"rendered":"Public Knowledge Files FCC Comments to Preserve Net Neutrality Rules"},"content":{"rendered":"\n<p>Today, Public Knowledge will file comments on the Federal Communications Commission\u2019s (FCC) recent Notice of Proposed Rulemaking to roll back the agency\u2019s <a href=\"https:\/\/publicknowledge.org\/public-knowledge-applauds-fcc-for-delivering-strong-open-internet-rules\/\">2015 Open Internet Order<\/a>, which created strong <a href=\"https:\/\/publicknowledge.org\/issue\/net-neutrality\/\">net neutrality rules<\/a> that force broadband providers to treat all internet content and services equally. The FCC\u2019s new proposal, if adopted later this year, would reverse the agency\u2019s classification of broadband service as a \u201ccommunications service\u201d under Title II of the Communications Act, and reclassify broadband as a Title I \u201cinformation service.\u201d As the courts have previously found, the FCC may only impose rules against blocking, throttling, or paid prioritization of content if it classifies broadband as a Title II service.<\/p>\n\n\n\n<p>The current rules, adopted in 2015 and <a href=\"https:\/\/publicknowledge.org\/dc-circuit-court-upholds-open-internet-rules-again\/\">affirmed by the D.C. Circuit twice<\/a>, prohibit Internet Service Providers (ISPs) from blocking lawful content, throttling users, creating \u201cfast lanes\u201d for favored content (aka paid prioritization), or generally interfering with a broadband subscriber\u2019s choice of content or web service. Public Knowledge opposes FCC Chairman Ajit Pai\u2019s move to gut these rules, which would leave<a href=\"https:\/\/youtu.be\/hv2EbV7bBNY\"> consumers<\/a>, <a href=\"https:\/\/www.usatoday.com\/story\/money\/business\/2017\/03\/20\/net-neutrality-small-business\/98900148\/\">small businesses<\/a>, <a href=\"https:\/\/youtu.be\/jXGMqXfYF3Q\">artists<\/a>, <a href=\"http:\/\/www.edudemic.com\/net-neutrality-huge-victory-education\/\">students<\/a>, <a href=\"http:\/\/www.healthcareitnews.com\/blog\/net-neutrality-will-benefit-remote-patient-monitoring\">hospital patients<\/a>, <a href=\"http:\/\/thehill.com\/blogs\/pundits-blog\/healthcare\/333581-rolling-back-net-neutrality-would-hurt-minorities-and-low#.WRsRjbog1Vk.twitter\">low-income families<\/a>, <a href=\"https:\/\/www.theverge.com\/2017\/4\/27\/15447394\/fcc-net-neutrality-roll-back-startups-letter-y-combinator\">startups<\/a> and<a href=\"http:\/\/www.bizjournals.com\/boston\/news\/2017\/04\/21\/net-neutrality-changes-would-kneecap-mass.html\"> entrepreneurs<\/a> unprotected and at the mercy of broadband providers following a slew of <a href=\"https:\/\/publicknowledge.org\/wp-admin\/%7Bpage_4890%7D\">mergers and media consolidation<\/a>.<\/p>\n\n\n\n<p>The following can be attributed to Ryan Clough, General Counsel of Public Knowledge:<\/p>\n\n\n\n<p>\u201cAs Public Knowledge\u2019s comprehensive filing of more than 100 pages makes abundantly clear, Chairman Pai\u2019s proposal would remove consumer protections the FCC has explicitly and repeatedly identified as critical to protecting broadband subscribers. It would for the first time explicitly make cable companies the gatekeepers of the internet. To attempt such a dramatic change of policy without even acknowledging the over 20 years of FCC past practice chronicled in these comments is the definition of arbitrary and capricious &#8212; and leaves Pai\u2019s proposal highly vulnerable to reversal in the courts.<\/p>\n\n\n\n<p>\u201cTwice opponents of Title II have pitched their alternate history of \u2018light touch regulation\u2019 to the D.C. Circuit in an effort to overturn the FCC\u2019s existing net neutrality rules. Twice the D.C. Circuit has flatly rejected it. Chairman Pai apparently thinks that the third time will prove the charm.
